Attached for review and consideration, please find Resolution No. 3 to approve the establishment of a Public Hearing date related to the special assessment project for certain public improvements to be constructed as part of the Miller Avenue Improvement Project - File No. 2009-023; Special Assessment District #40.

The improvements involve construction of sidewalk and concrete curb & gutter along Miller Avenue where none currently exist. The new sidewalk will allow safer access to the Miller Nature Area, and also to bus stops located on the south side of the street, and a continuous pedestrian connection. The new curb & gutter will provide proper stormwater control and address the reported runoff issues on several properties along the south side of the street.

This work will be included in the 2013 Miller Avenue Improvements Project (Maple Road to Newport Road), which was bid through the Michigan Department of Transportation and will be partially financed by Federal Surface Transportation Program - Urban (STPU) funds.

A public meeting/administrative hearing was held on June 27, 2012. Eighteen invitations were sent out to affected property owners, and four people attended the meeting. At the meeting, staff described the project, explained the need for the improvements, outlined some estimated costs, and received feedback from property owners. No strong objections to the project were voiced at the meeting. On August 20, 2012, City Council approved Resolution No. 1 authorizing staff to undertake this work as a special assessment project. A resolution to establish the project cost and the distribution of the individual costs amongst the affected properties defined as Special Assessment District #40 was placed before the City Council on May 6, 2013 for consideration of approval.
