Memorandum
This memorandum and resolution requests approval to award a contract to Fonson Inc. for the Plymouth Parkway Park Wetland Restoration in the amount of $97,687.50.
This project involves removing excess soils from an existing wetland that filled in during an embankment collapse of the Ann Arbor Rail Road along Plymouth Road in July of 2011. The Michigan Department of Environmental Quality requires that the wetland be restored to a condition equal to, or better than, prior to the embankment collapse.  Toward that end, approximately half of the spoils were removed from the site immediately after the collapse, and the bulk of the remainder was removed by City staff in June of this year.  The Ann Arbor Rail Road worked cooperatively with the City to restore and improve drainage systems in and around the railroad embankment.  The remaining work is to repair underground drainage systems in the park, complete final site grading and replant the wetland with appropriate species.
 
The City received the following six bids for construction services:

Fonson Inc.                                     $  97,687.50
Erie Construction                              $104,950.00
TSP Services, Inc.                              $116,042.00
Paymar Enterprises, Inc.                         $147,933.00
3-S Construction, Inc.                        $154,050.25
 
Stante Excavating's bid was found to be non-responsive and the bidder found non-responsible for this project.  Fonson Inc. submitted the next lowest and responsible bid in the amount of $97,687.50.  It is recommended that the bid from Fonson Inc. for $97,687.50 be accepted, and that Fonson Inc. be awarded the contract for the Plymouth Parkway Park Wetland Restoration.  
 
The total cost of the project is anticipated to be $107,687.50, which includes a contingency in the amount of $10,000.00 for Fonson Inc. for change orders to be approved by the City Administrator.
 
Fonson Inc. received Human Rights approval on January 19, 2012, and received contract compliance approval on April 30, 2012.
 
Funds for this project are available in the Public Services Parks Maintenance and Capital Improvements Millage Fund Balance, but need to be appropriated to the project budget within the Parks Maintenance and Capital Improvements Millage Fund.

Whereas, Maintaining high quality park facilities and improving the environment are priorities for the City;
 
Whereas, Funding for this project is available in the Public Services Parks Maintenance and Capital Improvements Millage Fund Balance;
 
Whereas, Of the six bids received, Fonson Inc. provided the lowest responsible bid in the amount of $97,687.50; and
 
Whereas, Fonson Inc. has received Human Rights approval on January 19, 2012, and received contract compliance approval on April 30, 2012;
 
Whereas, Funds for this project are available in the Public Services Parks Maintenance and Capital Improvements Millage Fund Balance, but need to be appropriated to the project budget within the Parks Maintenance and Capital Improvements Millage Fund.
 
RESOLVED, That $107,687.00 be appropriated from the Public Services Parks Maintenance and Capital Improvements Millage Fund Balance to establish the project budget within the Parks Maintenance and Capital Improvements Millage Fund;
 
RESOLVED, That the project budget in the amount of $107,687.00 is approved and that the funds be available for the life of the project until expended without regard to fiscal year;
 
RESOLVED, That Council accepts the proposal and awards a contract to Fonson Inc. in the amount of $97,687.50 for the contract for the Plymouth Parkway Park Wetland Restoration;
 
RESOLVED, That a contingency in the amount of $10,000.00 is approved to finance change orders to the contract with Fonson Inc. to be approved by the City Administrator;
 
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract for services after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
