Memorandum
There is a resolution before you to accept an easement for sanitary sewer and water main crossing the adjacent properties at 1301 Briarwood Circle Dr. and 1401 Briarwood Circle Dr. from Ann Arbor Lodging LS, LLC, a Wisconsin limited liability company and Ann Arbor Lodging EXT, LLC, a Wisconsin limited liability company.
The easement is in standard form and conveyed without cost to the City.
Acceptance of the easement is recommended.

Whereas, Ann Arbor Lodging LS, LLC, a Wisconsin limited liability company, and Ann Arbor Lodging EXT, LLC, a Wisconsin limited liability company are the owners in fee simple of adjacent properties, managed as a single parcel, and located in the City of Ann Arbor, County of Washtenaw, State of Michigan, as described in the Washtenaw County Records at Liber 4769, page 59 and Liber 4769, Page 58, and recorded on January 13, 2010;
Whereas, Pursuant to Corporate Resolution, Ann Arbor Lodging LS, LLC and Ann Arbor Lodging EXT, LLC authorize Robert J. Bruni, as Secretary, to act on behalf of the company;
Whereas, Ann Arbor Lodging LS, LLC and Ann Arbor Lodging EXT, LLC have delivered an easement for lands located in the City of Ann Arbor, County of Washtenaw to the City for the construction and maintenance of a municipally operated public service comprising the public utilities system to run with the land and burden the respective property perpetually, being more particularly described as follows:
40.00 FOOT WIDE WATER MAIN EASEMENT LOCATED IN THE NORTH ½ OF SECTION 8, T3S, R6E, CITY OF ANN ARBOR, WASHTENAW COUNTY, MICHIGAN; THE CENTERLINE OF WHICH IS DESCRIBED AS FOLLOWS:
Commencing at the northwest corner of Lot 12 of Briarwood Subdivision, Liber 22 of Plats, Page 66-75, of Washtenaw County records, thence S 43º29'00" W 15.53 feet to a POINT OF BEGINNING;
thence southeasterly 111.64 feet in the arc of a circular curve to the left having a radius of 470.78 feet, central angle 13º35'14", and chord S 53º18'39" E 111.38 feet;
thence continuing 111.22 feet in the arc of a circular curve to the left having a radius of 1511.95 feet, central angle 04º12'53", and chord S 62º12'42" E 111.19 feet;
thence S 16º56'15" W 174.12 feet to a point hereafter referred to as "Point A";
thence S 73º03'45" E 135.00 feet to a point hereafter referred to as "Point B";
thence N 16º56'15" E 150.00 feet;

thence southeasterly 227.82 feet in the arc of a circular curve to the left having a radius of 4538.57 feet, central angle 02º52'34", and chord S 72º26'36" E 227.80 feet to the POINT OF ENDING;
Together with a 40.00 foot wide water main easement, the centerline of which is described as follows:
Beginning at the above referenced "Point A" thence N 73º03'45" W 35.26 feet to the POINT OF ENDING.
Also together with a 40.00 foot wide water main easement, the centerline of which is described as follows:
Beginning at the above referenced "Point B" thence S 16º56'15" W 37.83 feet;
thence S 50º33'45" E 55.01 feet to the POINT OF ENDING.
Being a part of Section 8, T3S, R6E, City of Ann Arbor, Washtenaw County, Michigan, subject to easements and restrictions of record, if any.
VARIABLE WIDTH SANITARY SEWER EASEMENT LOCATED IN THE NORTH ½ OF SECTION 8, T3S, R6E, CITY OF ANN ARBOR, WASHTENAW COUNTY, MICHIGAN
Commencing at the Northeast corner of Lot 12 of Briarwood Subdivision, Liber 22 of Plats, Pages 66-75, of Washtenaw County records, thence southeasterly 150.00 feet in the arc of a circular curve to the left having a radius of 1496.42 feet, central angle of 05º44'35", and chord S 70º16'43" E 149.93 feet, thence S 73º09'00"E 22.60 feet to the POINT OF BEGINNING;
thence continuing S 73º09'00"E 152.61 feet;
thence S 14º37'52" W 30.00 feet;
thence N 73º09'00" W 39.40 feet;
thence N 75º22'08" W 125.48 feet;
thence S 89º35'38" W 178.98 feet;
thence N 22º35'40" E 32.59 feet;
thence N 89º35'38" E 187.10 feet to the POINT OF BEGINNING. Being a part of Section 8, T3S, R6E, City of Ann Arbor, Washtenaw County, Michigan, subject to easements and restrictions of record, if any.
RESOLVED, That the City of Ann Arbor hereby accept said grant of easement.
