Attached for your review and approval is a resolution to approve a best-source contract with Douglas N. Higgins, Inc. for the construction of approximately 147 linear feet of 12" ductile iron water main in South Fifth Avenue.  
 
The site plan approval for the City Place project included the upsizing of the existing 4" water main fronting the site to a 12" diameter main.  As a result, the development required the installation of approximately 515 linear feet of 12" water main in South Fifth Avenue from East William Street to the southerly limit of the site, 111 feet north of East Jefferson Street.  The development is also responsible for resurfacing the full width of South Fifth Avenue for the limits of this water main construction.
 
Upon completion of this requirement, there remains approximately 147 linear feet of undersized water main in South Fifth Avenue that should be upsized to 12" diameter to tie into the existing water main on East Jefferson Street.  It is advantageous for the City to extend the 12" water main to East Jefferson Street at this time, which would include upgrading an existing fire hydrant lead for improved fire protection for the area.  By having this work performed in coordination with the completion of the development's work in South Fifth Avenue, it will eliminate future water service disruption to the residents, upgrade fire protection in the area, and allow for complete resurfacing of this block of South Fifth Avenue.
 
The contractor for the City Place development, Douglas N. Higgins, Inc., has provided the city with a competitive price to complete this remaining amount of water main, as well as provide for the completion of the full width resurfacing of South Fifth Avenue to East Jefferson Street.  The work will also include the replacement of the sidewalk ramp at the northeast corner of East Jefferson Street and South Fifth Avenue for compliance with ADA standards.  
 
Funds for this contract are available in the approved Water Supply System capital budget.

Whereas, A private developer was responsible for installing approximately 515 linear feet of 12" water main in South Fifth Avenue from East William Street southerly, including full-width resurfacing of the road;
 
Whereas, Field Operations staff has determined it would be advantageous to the water utility and cost effective to complete the remaining portion of water main and street resurfacing in South Fifth Avenue to East Jefferson Street;
 
Whereas, The on-site contractor, Douglas N. Higgins, Inc., has presented the city with a quote that provides competitive pricing to complete this work;
 
Whereas, Completing the block of South Fifth Avenue from East William Street to East Jefferson Street with water main and street resurfacing at this time will eliminate future disruption to the community for this location;
 
Whereas, Funds for the project cost are available in the approved Water Supply System Capital Budget;
 
Whereas, Douglas N. Higgins, Inc. received Human Rights approval on April 23, 2012, and complies with the living wage ordinance; and
 
Whereas, The best-source contract with Douglas N. Higgins, Inc. for the installation of 147 linear feet of 12" ductile iron water main from the southerly limit of the City Place development to East Jefferson Street is a cost effective solution to complete the water main construction and resurfacing of this block of South Fifth Avenue;
 
RESOLVED, That a contract with Douglas N. Higgins, Inc. in the amount of $67,200.00 for the construction of 147 linear feet of 12" ductile iron water main in South Fifth Avenue be approved, subject to approval as to substance by the City Administrator and subject to approval as to form by the City Attorney;
 
RESOLVED, That the City makes the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds;
 
RESOLVED, That the Mayor and City Clerk be authorized to sign the agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions, to implement this resolution.
