Resolution to Accept Treated Wastewater Discharge to the POTW from Environmental Cleanup Activities at the Michigan Consolidated Gas Company Property at 841 Broadway Street

City Staff from both the Wastewater Treatment Plant and the Systems Planning Unit have been coordinating with DTE Energy staff to issue a permit to discharge treated wastewater from environmental cleanup activities at the site of the former Michigan Consolidated Gas Company Broadway Station, located at 841 Broadway Street.
Under the City's Sewage and Sewage Disposal Ordinance (Chapter 28), there are provisions for prohibited discharges to the City's sanitary sewer system. Section 2:43.1 (1)(l) allows a user to discharge effluent from environmental cleanup activities that are regulated under the Michigan Environmental Response Act (MERA) (1982 Public Act 307, as amended), if approved by City Council.
City WWTP staff plans to issue an Industrial User Permit to the Michigan Consolidated Gas Company for the discharge of industrial wastewater from the environmental cleanup activities, which are regulated under the Michigan Environmental Response Act (MERA) (1982 Public Act 307, as amended), into the City of Ann Arbor POTW (Publicly Owned Treatment Works). This industrial wastewater will be effluent from the dewatering water pretreatment system for the environmental cleanup. This discharge into the city system will be at a location identified in the Permit, and will be performed in accordance with the conditions set forth in the Permit and the City's Sewer Use Ordinance. The discharge location identified and approved by both parties is a sanitary manhole located approximately 125 feet south of the former Michigan Consolidated Gas Company service center building.
Compliance with the Industrial User Permit does not relieve the User of its obligation to comply with all applicable pre-treatment regulations, standards, or requirements under local, State, and Federal laws, including any such regulations, standards, requirements, or laws that may become effective during the term of the Permit. Non-compliance with any term or condition of this Permit shall constitute a violation of the City of Ann Arbor Sewer Use Ordinance.
The Systems Planning Unit is requesting that City Council authorize the Wastewater Treatment Plant to accept the treated discharge from environmental cleanup activities at the Michigan Consolidated Gas Company Broadway Station.

Whereas, The Michigan Consolidated Gas Company (Michcon) will be completing environmental cleanup activities at the site of the former Michcon Broadway Station, located at 841 Broadway Street;
Whereas, The cleanup activities will create wastewater effluent that cannot be discharged to the City's stormwater system, or to Waters of the State;
Whereas, Chapter 28, Section 2:43.1 (1)(l) prohibits any discharge from any environmental cleanup that is regulated under the Michigan Environmental Response Act (MERA) (1982 Public Act 307, as amended) into the City's sanitary system unless approved by City Council; and
Whereas, The City has a draft Industrial User Permit to the Michigan Consolidated Gas Company for the discharge of industrial wastewater from the environmental cleanup activities that are regulated under the Michigan Environmental Response Act (MERA) (1982 Public Act 307, as amended) through the location identified as a sanitary manhole located approximately 125 feet south of the former Michcon service center building;
RESOLVED, That City Council authorize the Wastewater Treatment Plant to accept the discharge from environmental cleanup activities at the site of the former Michcon Consolidated Gas Company Broadway Station at 841 Broadway Street.
