Resolution Approving a Grant of Easement to MichCon for Sanitary Sewer (Located at Broadway Park) (8 votes required)
Memorandum
There is a resolution before you to approve a grant of easement to Michigan Consolidated Gas Company (MichCon), a Michigan corporation, for the construction and maintenance of a sanitary sewer lead located in Broadway Park.
An existing sanitary sewer lead partially located in Broadway Park was discovered as part of the remediation work for the MichCon site at 841 Broadway. The Planning and Parks departments want the lead to remain in place for potential future use.
The terms, conditions, and location of the grant of easement have been reviewed and approved by all required City service areas. MichCon is required under the terms of the grant to file copies of "as built" drawings with the City and copies of all permits required in connection with construction and maintenance activities thereafter with the Parks Manager. Uninterrupted access to the park must be maintained at all times under the terms of the easement.
Approval of the grant of easement is recommended.

Whereas, MichCon, a Michigan corporation, has requested an easement for the construction and maintenance of a sanitary sewer located in Broadway Park; and
Whereas, The required City service areas have reviewed the request and determined that it is in the City's best interest to grant the easement;
RESOLVED, That the City of Ann Arbor hereby approve said grant of easement for the construction and maintenance of a sanitary sewer located in Broadway Park, said easement being more particularly described as follows:
DESCRIPTION OF A 30 FOOT WIDE SANITARY SEWER EASEMENT LOCATED IN THE SE ¼ OF SECTION 20 AND THE SW ¼ OF SECTION 21, T2S, R6E, CITY OF ANN ARBOR, WASHTENAW COUNTY, MICHIGAN
Commencing at an iron rod found in a monument box at the centerline of Fifth Avenue and Depot Street; thence S 63°55'58" E 533.25 feet along the centerline of Depot Street (66 feet wide) to the intersection with the centerline of Broadway Avenue (98 feet wide); thence N 54°28'17" E 219.41 feet along the centerline of Broadway Avenue to the North line of the Consolidated Railroad Corporation (formerly Michigan Central Railroad) Right-of-Way (100 feet wide); thence S 63°55'58" E 55.71 feet to the Point of Beginning:
thence N 54°28'17" E 34.11 feet along the Southeasterly Right-of-Way of Broadway Avenue;
thence S 63°55'58" E 287.64 feet;
thence S 26°04'02" W 30.00 feet;
thence N 63°55'58" W 303.86 feet along the Northerly Right-of-Way of Consolidated Railroad Corporation to the Point of Beginning. Being a part of the Southeast ¼ of Section 20 and the Southwest ¼ of Section 21, Town 2 South, Range 6 East, City of Ann Arbor, Washtenaw County, Michigan. Also being subject to easements and restrictions of record, if any.
RESOLVED, That the Mayor and City Clerk are authorized to execute the grant of easement in the form approved by the City Attorney.
