Resolution to Make Invalid Certain Sidewalk Occupancy Permits and Solicitor/Peddler Licenses During all Special Events Involving Closure of South Main Street Between Huron Street and William Street
Body
Whereas, The Main Street Area Association (MSAA) and other entities sponsor various special events that take place on South Main Street, which involve closing portions of South Main Street between Huron Street and William Street;
 
Whereas, These special events include, but are not limited to, Taste of Ann Arbor, Rolling Sculpture Car Show, Green Fair, FestiFools, etc.;
 
Whereas, The events are held to provide a variety of entertainment and educational events for the public to attend, which attract hundreds, and even thousands, of people to the downtown area;
 
Whereas, The City Council wishes to ensure that these special events are well-managed and held in a manner that does not compromise the health, safety and welfare of the general public and the public attending these events; and
 
Whereas, Under Chapter 47 (Streets and Sidewalks) of the Ann Arbor City Code, the City Council is permitted to restrict the issuance of Sidewalk Occupancy permits at times when congestion in a part of the City is too great to allow sidewalk occupancy and, under Chapter 79 (Solicitors and Peddlers) of the City Code, the City Council is permitted to restrict the issuance of Solicitor/Peddler licenses at times and places of special events;
 
RESOLVED, That beginning June 1, 2012, during all special events that involve the closing of any portion of Main Street between Huron Street and William Street, Sidewalk Occupancy permits and Solicitor/Peddler licenses be invalid on the following sidewalks and on all sidewalks and streets that are within the area defined by the following sidewalks:
 
Beginning with the sidewalks on the south side of East Huron Street from South Main Street to South Fourth Avenue;
 
Continuing with the sidewalks on the west side South Fourth Avenue to East William Street;
 
Continuing with the sidewalks on the north side of East William Street to South Ashley Street;
 
Continuing with the sidewalks on the east side of South Ashley Street to West Huron Street; and,
 
Continuing with the sidewalks on the south side of West Huron Street to the point of beginning.
 
RESOLVED, That the special events to which the restrictions contained in this resolution apply include, but are not limited to, Taste of Ann Arbor, Rolling Sculpture Car Show, the Children's Holiday Parade, Green Fair, FestiFools, etc.;
 
RESOLVED, That the restrictions contained in this resolution do not apply to Sidewalk Occupancy permits that are issued to businesses that have permanent locations in the area described above;
 
RESOLVED That this resolution replaces and supersedes the restrictions contained in resolution R-95-3-05, passed on March 21, 2005, and shall continue indefinitely until superseded by a subsequent resolution, ordinance, or other law;
 
RESOLVED, That the City Administrator and designees be directed to inform persons who are issued Sidewalk Occupancy permits and Solicitor/Peddler licenses of these restrictions; and
 
RESOLVED, That the City Administrator and designees be directed to enforce the law with respect to Sidewalk Occupancy permits and Solicitor/Peddler licenses after such persons have been ordered to vacate the restricted area but refuse to comply.
