Memorandum
Attached for your review and approval is a resolution to approve a change order to the contract with Site Development, Incorporated in the amount of $27,776.00.
 
The improvements to West Park included improvements to stormwater quality and enhancements to the park, including access improvements, seat walls in the hillside at the historic bandshell, renovations to the bandshell, boardwalk and pond overlook construction, parking lot reconstruction, basketball court replacement, prairie, wetland and tree planting. The project included installation of eight hydrodynamic separaters that were designed to reduce sediment and phosphorus inputs into the Allen Creek.
 
City Council approved the contract with Site Development, Incorporated (Bid #4052) for construction of the project in the amount of $1,443,000.00, including a construction contingency in the amount of $144,300.00 (10%) to cover contract change orders, for a total construction budget of $1,587,300.00. Five previous change orders have been approved within the 10% contingency amount to cover unforeseen changes, including undercutting due to poor soils, repairs from extensive storm damage, revisions to the stormwater structures in the park, additional work on Seventh Street due to conflicts with underground utilities, electrical service relocation, additional landscaping, and earthwork in conjunction with the house removed on Chapin.
 
In November, 2010, one of the hydrodynamic units failed. This sixth change order directed the contractor to provide barricade fencing around all eight units to prevent traffic and pedestrians from entering the area, backfill the hole created by the collapse, remove the weir wall from the diversion structure, and bulkhead of the pipes to prevent backwater from entering the structures downstream.
 
This proposed change order of $27,776.00 brings the contract amount above the 10% contingency originally approved by City Council on November 16, 2009 (Resolution R-09-468) by $24,335.98 or 1.5% of the approved contract amount.  Funding for this change order is from Public Services "West Park Storm System Modifications", which was established to cover work in conjunction with the failure of the unit.

Whereas, On November 16, 2009 City Council approved a contract with Site Development, Incorporated, per bid #4052 (Resolution R-09-468) for construction of the West Park Improvements Project in the amount of $1,443,000.00 and approved a construction contingency in the amount of $144,300.00 (10%) to cover potential contract change orders for a total construction budget of $1,587,300.00 for the life of the project without regard to fiscal year;
 
Whereas, Five change orders have been approved within the 10% construction contingency to cover unforeseen changes;
 
Whereas, A sixth change order in the amount of $27,776.00 to make the site safe after the failure of one of the hydrodynamic separators will bring the contract amount above the 10% contingency by an additional $24,335.98; and
 
Whereas, Funding is available in the West Park Storm System Modifications project to fund this change order;
 
RESOLVED, That City Council approves a change order to the contract with Site Development, Incorporated. in the amount of $27,776.00; and
 
RESOLVED, That Council authorizes the City Administrator to take the necessary administrative actions to implement this resolution, including execution of the sixth change order.
