Attached for your review and approval is a resolution to award a construction contract to Barrett Paving Materials, Inc. in the amount of $4,054,599.12 for the 2012 Street Resurfacing Project - Program B.
The 2012 Street Resurfacing Project - Program B is the second of two resurfacing contracts for this year. We presented Program A to Council on April 2, 2012. This year's resurfacing program includes more than double the number of streets typically included in our annual resurfacing program. Due to the expected workload, staff divided the project into two contracts as some contractors may not have the resources to handle the entire street list. Barrett Paving was the low bidder on both contracts and we believe they have the resources to successfully complete both projects.
Program B consists of the resurfacing of approximately 1 major street (Seventh Street) and 20 local streets located throughout the City. The street list has been attached. Construction is scheduled to begin approximately April 30, 2012 and to be completed in October 2012. A tentative timeframe for construction is shown, however, the exact schedule for each street will be adjusted to best coordinate with scheduled City events (such as Art Fair, U of M home football games, and in-session school days) and other road construction projects.
The Street Resurfacing Project is created as a unit price contract with the understanding that the actual quantities used in construction will vary. Reflecting this flexibility, if any streets on the existing list are removed for any reason, such as conflicts with other projects, need for extensive utility repair, or any other unforeseen circumstances, other streets within the city may be substituted. If the funds are depleted prior to the completion of all the streets listed on the attachments, the construction contract will be terminated and the balance of the streets will be deferred to a future Resurfacing Project.
Traffic Control During Construction
For all the streets, local access will be maintained throughout the construction. To allow for construction on Seventh Street, thru traffic will be reduced to one-way southbound. Northbound traffic will be detoured via Pauline, Main Street, and Madison.
Public Outreach
In early-March, an informational postcard was mailed to all residents within the resurfacing limits of each street. The postcard notified the residents of the project and provided resources to find more information (staff contacts and the web page; www.a2gov.org/RoadConstruction <http://www.a2gov.org/RoadConstruction>). The postcard also invited people to the public meeting scheduled for the evening of March 20, 2012 at Slauson Middle School. Also, an advertisement with the street list and contact information was included in the March Ann Arbor Observer.
Residents will receive another notification prior to construction beginning on each street and regular emails will be sent to keep people informed on the progress of the construction.
Bidding
Plans and specifications were distributed electronically to contractors, subcontractors, and suppliers. Three bids were received and opened on March 16, 2012. The lowest responsible bid, in the amount of $4,054,599.12 is approximately $349,900.00 lower than the engineer's estimate of $4,404,500.00. A tabulation of the bids is attached.
Barrett Paving Materials, Inc. received Human Rights approval on March 5, 2012. All employees of Barrett Paving Materials, Inc., assigned to work on the project will receive compensation in accordance with the Living Wage Ordinance.
The project will be funded primarily from the Approved Street Resurfacing Millage Capital Budget.

Whereas, The City of Ann Arbor Adopted 2012 Capital Budget includes sufficient funds for the Annual Street Resurfacing Project;
Whereas, The 2012 Street Resurfacing Project includes the resurfacing and/or reconstruction approximately 1 major street and 20 local residential streets located throughout the City;
Whereas, The 2012 Street Resurfacing Project is necessary to maintain high quality streets in the City of Ann Arbor;
Whereas, Competitive bids were received by Procurement on March 16, 2012 and Barrett Paving Materials, Inc. was the lowest responsible bidder at $4,054,599.12;
Whereas, The contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City therefore, all of which are agreeable to the City;
Whereas, It is now necessary to enter into a Contract with said company for said construction project; and
Whereas, Barrett Paving Materials, Inc. received Human Rights approval on March 5, 2012, and its employees will receive compensation in accordance with the Living Wage Ordinance;
RESOLVED, That a contract in the amount of $4,054,599.12 be awarded to Barrett Paving Materials, Inc. for the construction of the 2012 Street Resurfacing Project - Program B;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the City Administrator;
RESOLVED, That a contingency amount of $405,000.00 be established within the project budget and that the City Administrator be authorized to approve additional change orders to the construction contract with Barrett Paving Materials, Inc., not to exceed $405,000.00 in order to satisfactorily complete this project;
RESOLVED, That the City Administrator is authorized to take necessary administrative actions to implement this project, including issuing Traffic Control Orders for the streets included in the 2012 Street Resurfacing Project - Program B, including parking prohibition as needed in excess of 1 block and/or 90 days; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
