Memorandum
Trinitas Development, LLC has filed a claim of appeal against the City following City Council's denial of the Cottages at Barton Green Site Plan;
The City Attorney selected the Rosati, Schultz, Joppich, & Amtsbuechler P.C., law firm to provide legal advice regarding this claim of appeal. The selection is based on the firm's familiarity with the issues and the firm's experience and expertise.
Rosati, Schultz, Joppich, & Amtsbuechler P.C. complies with the City of Ann Arbor's Non-Discrimination and Living Wage Ordinances.
Approval of a the professional services agreement with Rosati, Schultz, Joppich, & Amtsbuechler P.C. in the amount of $150,000.00 for legal services relative to the Cottages at Barton Green Site Plan is recommended.
Fiscal/budget impact: Funding for these services were not planned for in the FY2019 adopted budget. Funding is requested from the General Fund balance.

Whereas, Trinitas Development, LLC has filed a claim of appeal against the City following the City Council's denial of the Cottages at Barton Green Site Plan;
Whereas, The Rosati, Schultz, Joppich, & Amtsbuechler P.C. law firm is well qualified to provide legal services representing the City relative to the Cottages at Barton Green Site Plan, including representing the City in negotiations as well as in litigation;
Whereas, The City Attorney recommends a contract for legal services for an amount not to exceed $150,000.00; and
Whereas, Rosati, Schultz, Joppich, & Amtsbuechler P.C., complies with the City of Ann Arbor's Non-Discrimination and Living Wage Ordinances;
