Resolution to City Council Regarding the AAPOA CBA and Other Policies
Memorandum
The Independent Community Police Oversight Commission adopted this resolution at the July 1, 2020 electronic special meeting of the commission.
Body
Whereas, the City of Ann Arbor has charged the Independent Community Police Oversight Commission (ICPOC) with oversight of AAPD services and review of AAPD incidents;
Whereas, all ICPOC Commissioners have signed a confidentiality agreement that precludes commissioners from sharing, with the public or press, confidential and personnel information obtained in the course of their ICPOC work;
Whereas, the Independent Community Police Oversight Commission was instituted to advise both the City Council and the Ann Arbor Police Department on policies and practices;
Whereas, it is the mission of ICPOC to enhance communication and sharing of information between the AAPD and the community;
Whereas, it is the mission of ICPOC to build mutual trust between the community and AAPD;
Whereas, the Ann Arbor community relies upon ICPOC, as an independent arbiter, to increase transparency and accountability by providing the public with a thorough, accurate review of police complaints;
Resolved, ICPOC requests access to all police officer names as it reviews complaints against police personnel and police incidents;
Resolved, ICPOC, requests that if the City is unwilling or unable to attain substantial changes to the AAPOA CBA, including items below, that the City limit the duration of the AAPOA CBA to one year, to expire December 2020;
? ICPOC requests revision of AAPOA CBA Article 26, section 5 to be revised to include access to members of ICPOC in the review of officer personnel files;
? ICPOC requests that Article 5, Section 4 be revised such that discipline recommendations shall not be based on infractions which have occurred more than seven (7) years (84 months) prior to the incident under investigation;
