Attached for your review and approval is a resolution authorizing the approval of a Professional Services Agreement with Washtenaw County for Case Management Services.
Diversion is an agreement between a criminal offender and the prosecutor to address root causes of involvement with the criminal justice system, demonstrate accountability, and make amends with the community/victim in exchange for a reduced charge or dismissal of criminal charges.
After being charged with a crime, an offender may be eligible to divert their charge out of the criminal justice system.
The County Prosecutor has created a Pretrial Diversion Program to address the fact that the mere act of entering a guilty plea can trigger collateral consequences. People who plead guilty to a crime may be unable to secure housing or jobs, and noncitizens may face immigration consequences.
Under this Agreement, the 15th District Court Probation Department would provide case management services for up to 150 defendants charged in the 15th Judicial District Court with low-level misdemeanors, who are eligible to participate in the County Prosecutor's Pretrial Diversion Program.
Budget/Fiscal Impact: Revenue for these services was not included in the Court's approved FY22 Budget. Additional expenditures related to this program are not anticipated for FY22.
