Memorandum
This memorandum and resolution request approval of the Board of Insurance Administration’s June 24, 2021 recommendation to deny the claim filed by claimant State Farm on behalf of their insured Nancy J. Allee. State Farm submitted a claim against the City to the Board of Insurance Administration in the amount of $11,014.87 for a sewer backup. The Board of Insurance Administration denied the claim on the basis of governmental immunity. The claimant had up to 30 days after notification in writing of the Board’s decision to appeal. The 30-day period has passed and no appeal has been filed.

Whereas, Council must approve the Board of Insurance Administration’s recommendations for claims and appeals in excess of $10,000.00; and
Whereas, the Board of Insurance Administration recommended the denial of the claim filed by State Farm on behalf of their insured Nancy J. Allee for a sewer backup in the amount of $11,014.87 on the basis of the City’s governmental immunity;
RESOLVED, That Council approve the Board of Insurance Administration’s denial of the claim of State Farm for a sewer backup (CC041-21); and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
