Memorandum
The City has been sued in the Washtenaw County Circuit Court, Case No. 24-000490-NI the Estate of Seth Sugar by its Personal Representative Bryan Sugar v. Jacob Nilsson, the City of Ann Arbor, Bird Rides, Inc., Spin, and Tier Mobility.
The City Attorney's Office selected the law firm of Cummings, McClorey, Davis & Acho, P.L.C. to provide specialized litigation services in this case. The selection is based on the firm's expertise with the specialized legal issues and the firm's proven experience in defending similar cases.
Cummings, McClorey, Davis & Acho, P.L.C. complies with the City of Ann Arbor's Non-Discrimination and Living Wage Ordinances.
The City Attorney's Office requests approval of the legal services agreement with Cummings, McClorey, Davis & Acho, P.L.C. in the amount of $145,000.00 for legal services.
Budget/Fiscal Impact: Funding for these services are available in the Major Street Fund.

Whereas, The Estate of Seth Sugar by its Personal Representative Bryan Sugar has filed a lawsuit against the City of Ann Arbor;
Whereas, The law firm of Cummings, McClorey, Davis & Acho, P.L.C. is well qualified to provide legal services representing the City in this action;
Whereas, Initial funds are needed to provide a defense in this litigation; and
Whereas, Cummings, McClorey, Davis & Acho, P.L.C. complies with the City of Ann Arbor's Non-Discrimination and Living Wage Ordinances;
RESOLVED, That City Council approve a Legal Services Agreement with Cummings, McClorey, Davis & Acho, P.L.C. in the amount of $145,000.00 to provide continuing legal services;
