Resolution To Approve the Transfer of 2072 Garden from the City of Ann Arbor to the Ann Arbor Housing Commission
Memorandum
The Ann Arbor Housing Commission owns a single-family home at 2072 Garden Circle, Ann Arbor, MI, that was built in 1971 through HUD's Turnkey III program. The AAHC was approved by HUD to dispose of the property through the Section 18 Disposition process for Very Small PHAs, through the HUD Special Applications Center (SAC). The property will be transferred from the City of Ann Arbor for $1.00 to the Ann Arbor Housing Commission. The AAHC will execute a ground lease with Colonial Oaks, LLC and a Use Agreement with HUD restricting future residents to 60% AMI.

Whereas, the Ann Arbor Housing Commission (the "Commission") is a public body corporate, which is separate from the City of Ann Arbor (the "City"), and the Commission provides management and oversight to affordable housing within the City;
Whereas, the Commission has successfully removed or converted all of its units from its public housing inventory and now will dispose of its sole remaining public housing unit pursuant to Section 18 of the U.S. Housing Act of 1937 (42 U.S.C. 1437p) and 24 C.F.R. 970;
Whereas, the Commission's last remaining public housing unit is located at 2072 Garden Circle Ann Arbor, MI 48103 (the "Property") and must be transferred out of the City's ownership to the Commission to then be transferred to Colonial Oaks, LLC, an entity related and controlled by the Commission, to complete the closeout of the Commission's public housing inventory;
Whereas, in June 2013, Ann Arbor City Council approved R-13-173 to transfer ownership of 26 properties (inclusive of 2072 Garden Circle) the City acquired for the Commission to the Commission for one dollar per parcel;
