Resolution to Approve Fees for New Medical Marijuana Facilities Annual Permits
Memorandum
Chapter 96 of the Ann Arbor City Code was adopted to allow for the issuance of permits and to regulate the operation of medical marijuana facilities within the City, to the extent that they are permitted under the Michigan Medical Marihuana Facilities Licensing Act. Attached for your consideration and approval is a resolution establishing new fees for a medical marijuana facilities permit from the City.
Under the provisions of the new chapter, medical marijuana facilities within the City must possess a State license in order to operate, as well comply with all requirements of Chapter 96, including zoning compliance and local permit approval. All five licenses allowed under the MMFLA; grower, processor, secure transporter, provisioning center, and safety compliance facility are also permitted in the City. Under the ordinance, the City is required to charge a non-refundable application fee, which shall be determined by resolution of City Council.
The City Administrator is recommending that the maximum allowable fee of $5000 per application, under the Michigan Medical Marihuana Facilities Licensing Act, be approved.
