Memorandum
This resolution will approve a development agreement between the City of Ann Arbor and the Ann Arbor Housing Commission and Related Midwest, the co-developers of a project to develop a 20-story building containing retail uses on the ground floor and 330 apartments on the upper floors, and create a shared service drive along the north side of the site for building services and future use by AAATA for additional bus boardings.

The 0.8-acre site is zoned 350 S Fifth Ave PUD district with Supplemental Regulations adopted by Ordinance 22-03 to permit such development. The City Planning Commission approved the site plan on October 16, 2025 with conditions, subject to entering into and satisfying all terms of a development agreement.

Whereas, The 350 S. Fifth Ave. Site Plan was approved by the City Planning Commission on October 16, 2025 to develop a high-rise, mixed-use building containing 330 affordable apartments and a shared service drive for future use by AAATA, subject to entering into and satisfying all terms of a development agreement; and,

Whereas, A development agreement has been prepared to address granting easements and restoring the South Fourth Avenue streetscape;

RESOLVED, That City Council approves the development agreement, substantially in the form of that attached;
