Resolution to Approve an MOU between the City of Ann Arbor, Downtown Development Authority and The Regents of the University of Michigan for the Elevate Art Program at McDivitt-White Plaza
Memorandum
DDA has established an art program known as Elevate, whereby DDA finances the creation of artwork which is then installed in various public or private locations in the City on a temporary or permanent basis. The City participates in the process in various ways including, but not limited to, reviewing installation, including materials and content. The University owns the property known as McDivitt-White Plaza, at the intersection of East University and South University Avenue. The City and DDA have requested and the University has agreed in principle to create a framework to allow installation of public art in McDivitt-White Plaza.

Whereas, The City and DDA participate in the Elevate program to install artwork in high-visibility areas around the City; and

Whereas, The City, DDA, and University wish to establish a framework to allow placement of public art in McDivitt-White Plaza, a prominent and highly visible location in the City;

RESOLVED, That City Council approves a Memorandum of Understanding (“MOU”) establishing a framework to allow placement of public art in McDivitt-White Plaza;

RESOLVED, That the Mayor and Clerk are authorized to execute the MOU after approval by the City Attorney and City Administrator; and

RESOLVED, That the City Administrator is authorized to take all appropriate actions to implement this resolution and the MOU, exercise all determinations and authority delegated to the City under the MOU and any subagreement contemplated by this resolution, and negotiate, execute, and manage all ancillary documents, inst...
