An Ordinance to Add Chapter 35 (Sustainable Energy Utility) to Title II (Utilities and Services) of the Code of the City of Ann Arbor

Memorandum

Staff recommends adoption of the attached ordinance to add Chapter 35 (Sustainable Energy Utility) to Title II of the Code with the explicit aim of meeting two key purposes:

 

First, as directed by Section 15.10 of the City Charter, establish the City of Ann Arbor’s Sustainable Energy Utility (“A2SEU”) for the purpose of providing an opt-in, fee-based, supplemental, municipally-owned energy utility that provides 100% renewably-sourced electricity, heat, cooling, light, and power, as well as other energy-related services, at participating homes, businesses, and other properties in the City.

 

Second, establish standards, rules, and regulations with respect to the A2SEU, including prescribing the powers and duties of certain municipal agencies, departments, and officials with regard to the A2SEU.

 

The attached ordinance provides key operational and governance elements required to officially establish and begin operating the A2SEU.

   

Budget/Fiscal Impact: The addition of Chapter 35 to the Code does not require any funding. However, implementation of the A2SEU will require funding, some of which has been secured through grant awards, some of which will need to be financed through bonds, and some of which may be financed through other sources. Resolutions related to such funding will be brought to Council for consideration as they occur.
