Resolution to Approve Grants of Easement for Access over 819 W. Huron Street to Abutting Property Owners (8 Votes Required)
Memorandum
The City owns 819 W. Huron Street which it received through a tax foreclosure (Liber 5070, page 912, Washtenaw County Records). This parcel is landlocked, with no access to a public street, and the City has no infrastructure located within this parcel.
An abutting property owner has requested an access easement over this parcel. It appears the parcel has been used for access by at least some of the abutting parcels previously. As the City's parcel has no access to a public street, property owners must make their own arrangements with other private property owners to access this parcel.
This resolution authorizes the granting of an access easement without charge over 819 W. Huron to any abutting property owner who requests, on condition that the grantee waives all claims against the City with respect to the parcel and agreeing that the City has no obligation to maintain the parcel for access or any other purpose.

Whereas, An abutting owner has requested an access easement over 819 W. Huron;
RESOLVED, That City Council approves the grant of an easement for access over the City parcel commonly known as 819 W. Huron to any abutting property owner who requests the City in writing;
RESOLVED, That the grant of easement shall be for no charge, conditioned on the grantee waiving all claims against the City with respect to the parcel, agreeing that the City has no obligation to maintain the parcel for access or for any other purpose, and such other terms as the City Attorney deems appropriate; and
