Memorandum
These easements are being given pursuant to the site plan for the 900 Briarwood Circle Redevelopment as approved by City Council on December 4, 2023, in R-23-438. Separate easement documents will be executed by Mall at Briarwood LLC, owner of 100 and 806 Briarwood Circle, Federated Retail (Macys, Inc.), owner of 700 Briarwood Circle, SPG Briarwood Holdings LLC, owner of 810 Briarwood Circle, Briarwood Outparcel LLC, owner of 900 Briarwood Circle and Briarwood Multifamily LLC, owner of 920 Briarwood Circle as the owners of portions of property that are part of the 900 Briarwood Circle Redevelopment site plan and a Settlement Agreement of Briarwood Capital Cost Recovery Fee Dispute and Release of All Claims.

Whereas, Mall at Briarwood LLC, owner of 100 and 806 Briarwood Circle, Federated Retail (Macys, Inc.), owner of 700 Briarwood Circle, SPG Briarwood Holdings LLC, owner of 810 Briarwood Circle, Briarwood Outparcel LLC, owner of 900 Briarwood Circle and Briarwood Multifamily LLC, owner of 920 Briarwood Circle (“Owners”), are the owners of property that are part of the 900 Briarwood Circle Redevelopment site plan; and
Whereas, The Owners have agreed to execute grants of easement for utilities and appurtenances as to their respective parcels, the descriptions of which are described and illustrated in the attached drawings;
RESOLVED, That the City of Ann Arbor hereby accepts these grants of easement after execution by the respective granting parties and approval by the City Attorney.
