Title
Resolution to Approve Amendment No 1 to the Professional Service Agreement with Transportation Engineering Design, DPC for the North Main Street Transportation Study Project (Additional $9,816.00 for a Contract Total of $609,687.00)
Memorandum
This resolution requests approval of Amendment No.1 to the professional services agreement for the North Main Street Transportation Study with Transportation Engineering Design DPC, (an affiliate of Toole Design Group, LLC). On July 7, 2025, City Council passed Resolution 25-245 to approve a contract with Transportation Engineering Design, DPC, for a contract amount of $599,871.00.

Two factors have required additional consultant staff effort beyond what was anticipated in the original scope of the project. Individually, these efforts were modest, but together they have had an impact on the project budget and the contract would be short $9,816.00.

There are several factors causing this shortfall:
Additional Meetings - additional presentations to DDA Board, additional meetings with City Council members, and two additional meetings with MDOT staff. We expect there may be additional meetings with MDOT before the end of the contract period as well.
Public Comment – the project scope included several public engagement deliverables. However, responding in detail to individual public comments required significant additional time, particularly as we developed the in-person and virtual engagement materials for the two charrettes.

The existing cost sharing agreement with the Ann Arbor Downtown Development Authority splits the contract budget to be city share 57% and DDA share at 43%.

TED complies with the requirements of the City’s Non-Discrimination and Living Wage Ordinance.

The project is anticipated to be completed by the end of 2026.

Budget/Fiscal Impact: The funding for this work will be provided by a partnership with the Downtown Development Authority through a cost sharing agreement (A2-0007248 | 12-15-2025). ...
