Resolution to Restate and Rename the Downtown Area Citizens Advisory Council to the Downtown Development Area Resident Consultancy Council

Whereas, In 1982 City Council passed Resolution R-361-8-82 establishing a Downtown Development Authority Development Area Citizens Council, as required by the Downtown Development Authority Act (PA 197 of 1975) to act in an advisory capacity on the DDA's proposed development and TIF plans;

Whereas, In 2005 City Council passed Resolution R-44-2-05 changing the official name of the Downtown Development Authority Development Area Citizens Council to Downtown Area Citizens Advisory Council;

Whereas, As required in MCL 125.4221 (PA 57 of 2018), the Recodified Tax Increment Financing Act, members of the Downtown Area Citizens Advisory Council shall be residents of the development area;

Whereas, All residents within the development area are eligible to serve on the Downtown Area Citizens Advisory Council;

Whereas, The Downtown Development Authority is underway with creating new development and TIF plans in alignment with City goals and State statute, including requirements to consult with the established development area citizens council regarding development and tax increment financing plans;

Whereas, Changing the official name of the Downtown Area Citizens Advisory Council to Downtown Development Area Resident Consultancy Council (DDARCC) reflects statute eligibility requirements inclusive of all residents and the consultative nature of the council;

RESOLVED, That the body formerly known as the Downtown Area Citizens Advisory Council, as stated in City Council Resolution R-44-05, is renamed the Downtown Development Area Resident Consultancy Council ("DDARCC");

RESOLVED, That the DDARCC shall function as the "development area citizens council" described in MCL 125.4222-4227 of the Recodified Tax Increment Financing Act (PA 57 of 2018);
