Resolution to Accept a Sanitary Sewer Easement in Vacated East University Avenue from The Regents of the University of Michigan (8 Votes Required)
Memorandum
The City has requested this additional 10-foot easement to widen an existing sanitary easement that was reserved by the City when it vacated East University Avenue between South University Avenue and North University Avenue in 1970. The existing easement is only 20 feet wide, which does not meet the City’s current standard width for sanitary easements. This easement expands the easement City-standard 30 feet wide.

City staff have discussed this with University staff and it is expected that the Regents will approve the grant of easement at an upcoming meeting. This resolution accepts the easement contingent upon Regent approval.

Staff Note: The City’s original vacation of East University Avenue and reservation of easement was recorded in Liber 1315, page 687, Washtenaw County Recrods, and approved by City Council on February 2, 1970 in R-47-2-70.

Whereas, The Regents of the University of Michigan, a Michigan Constitutional corporation, are the owner of property commonly known as vacated East University Avenue, Ann Arbor, Michigan 48104; and

Whereas, The City has requested that the University of Michigan grant an easement for sanitary sewers and appurtenances as shown and described in the attached easement and map and as follows:

COMMENCING AT THE SW CORNER OF LOT 21 OF "R.S.
