Whereas, 707 Church Street Owner, LLC, a Delaware limited liability company, is the owner of property commonly known as 701 Church Street, Ann Arbor, Michigan 48104; and
Whereas, 707 Church Street Owner, LLC, has signed a grant of easement for public sidewalk as shown and described below and on the attached easement and map:
A variable width sidewalk easement located in the SW 1/4 of Section 28, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan, and being part of R.S. Smith's 2nd Addition to the City of Ann Arbor as recorded in Liber 48, Page 40, Washtenaw County Records, more particularly described as: BEGINNING at the Northwest Corner of Lot 5, Block III, said R.S. Smith's 2nd Addition to the City of Ann Arbor; thence N88°49'47"E 132.61 feet along the North line of said Block III, R.S. Smith's 2nd Addition to the City of Ann Arbor and South right-of-way line of Willard St (49.5 feet Wide); thence S01°04'57"E 3.00 feet along the East line of said Block III, R.S. Smith's 2nd Addition to the City of Ann Arbor; thence S88°49'47"W 130.10 feet; thence S01°19'51"E 321.00 feet; thence S88°49'47"W 2.50 feet; thence N01°19'51"W 324.00 feet along the West line of Lot 2 and said Lot 5, Block III, R.S. Smith's 2nd Addition to the City of Ann Arbor and the East right-of-way line of Church Street (66 feet wide) to the POINT OF BEGINNING. Being subject to easements and restrictions of record, if any.
RESOLVED, That the City of Ann Arbor hereby accepts this grant of easement.
