Attached for your review and approval is a resolution to award a construction contract to Erie Construction, LLC in the amount of $79,556.00 for the Wetland Mitigation at Leslie Park Golf Course Project.
In the summer of 2017, a modern roundabout was constructed at the intersection of Dhu Varren Road, Green Road, and Nixon Road to improve the intersection’s capacity, operational efficiency, and road safety for all users.
The reconstruction of the intersection included the realignment of the Dhu Varren Road to the south, and had unavoidable impacts on approximately 0.31 acres of adjacent wetland in the Traver Creek sub-watershed of the Huron River watershed. The MDEQ permit required wetland mitigation at a 1:1 ratio, which was satisfied by the purchase of wetland mitigation bank credits at the Huron River Watershed Wetland Mitigation Bank. With the purchase of the bank credits and the completion of the road improvements, the project has met the MDEQ permit conditions.
However, since the bank is located outside of the City of Ann Arbor, the local mitigation at a 1:1.5 ratio located with the city limits was required to meet the City of Ann Arbor wetland mitigation ordinance. To ensure proper wetland function and value replacement, the local mitigation was proposed within the same sub-watershed as the impacts (Traver Creek) by means of wetland creation at the City of Ann Arbor owned Leslie Park Golf Course. In addition to the 1:1.5 ratio, an additional 10% of the impacted area is to be created to ensure the suitable area requirements are achieved and to guarantee no net loss of wetland resources within the City of Ann Arbor. Therefore, the proposed wetland mitigation shall create 0.52 acres of emergent wetland (wet meadow) in the Traver Creek sub-watershed of the Huron River watershed.
To ensure successful establishment, the wetland mitigation shall be periodically monitored and managed as necessary by the City of Ann Arbor.
Project plans and specifications were distributed electronically to contractors, subcontractors, and suppliers through the City of Ann Arbor’s procurement website and MITN.info. Three bids were received and opened on July 23, 2019. The lowest responsible bid, from Erie Construction, LLC in the amount of $79,556.00 is approximately at the Engineer’s Estimate. Attached is a summary of the bids received for the project.
Erie Construction, LLC has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination and Living Wage Ordinances.
The construction of the project is scheduled to be completed in October of 2019.
Budget/Fiscal Impact: Work for this project is included in the Capital Improvement Plan (CIP) as part of Nixon/Green/Dhu Varren Intersection Improvement Project (TR-SC-16-18). Funding for the project is included in the approved project budget.

Whereas, In addition to the MDEQ permit requirement, the City of Ann Arbor wetland mitigation ordinance requires additional local mitigation at a ratio of 1:1.5, to be located with the city limits;
Whereas, The Leslie Park Golf Course was identified as the ideal location for the wetland mitigation work;
Whereas, Funding is included in the approved project budget;
Whereas, Competitive bids were received by Procurement on July 23, 2019 (ITB-4591) and Erie Construction, LLC was the lowest responsible bidder with a submitted bid of $79,556.00;
Whereas, The contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City there for, all of which are agreeable to the City;
Whereas, It is now necessary to enter into a Contract with said company for this construction project; and
Whereas, Erie Construction, LLC., has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination and Living Wage Ordinances;
RESOLVED, That a contract in the amount of $79,556.00 be awarded to Erie Construction, LLC for the construction of the Wetland Mitigation at Leslie Park Golf Course Project;
RESOLVED, That a contingency amount of $10,000.00 be established within the project budget and that the City Administrator be authorized to approve change orders to the construction contract with Erie Construction, LLC not to exceed that amount, in order to satisfactorily complete this project;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the Public Services Area Administrator and City Administrator; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution including approval of needed Traffic Control Orders, off-hours work authorizations, and other similar administrative approvals to allow the work of the project to proceed without delay.
