Resolution to Approve a Construction Contract with E.T. MacKenzie Company for the Allmendinger Park Improvements Project ($533,990.00)

Memorandum

Attached for your review and approval is a resolution to approve a construction contract between the City of Ann Arbor and E.T. MacKenzie Company in the amount of $533,990.00 for the Allmendinger Park Improvements Project (RFP 24-56).

 

This project includes improvements to Allmendinger Park, including installation of accessible parking spaces, new entrance and pathway pavement, fencing, grills and stormwater improvements.

 

Solicitation of Bids:  Park staff solicited proposals with Public Improvement Request for Proposal 24-56 through the City’s Procurement Unit.  The documents were advertised on the City’s Website and on the Michigan Inter-governmental Trade Network (MITN) website. On December 10, 2024, six (6) proposals were received and publicly opened.

 

A selection committee comprised of Community Services staff and managing consultants reviewed the proposals and determined which bidder was the Best Value based on the criteria in ORD-21-41:

 

                     Qualifications, Experience, & Accountability (20%)

                     Workplace Safety (20%)

                     Workforce Development (20%)

                     Social Equity & Sustainability (20%)

                     Schedule of Pricing/Cost (20%)

 

After reviewing and scoring the proposals, staff ranked the responding firms in the following order:

 

1.                     E.T. Mackenzie Company

2.                     Major Contracting Group, Inc.

3.                     KAB Enterprises, Inc.

4.                     Decima LLC

5.                     DMC Consultants, Inc.

6.                     Michigan Recreation Construction, Inc.

 

E.T. Mackenzie Company received the highest score among the proposals reviewed by the selection committee. Therefore, staff recommends approving a contract with E.T. Mackenzie Company in the amount of $533,990.00 for the project.

 

E.T. Mackenzie Company complies with the requirements of the City’s Non-Discrimination, Prevailing Wage, and Living Wage Ordinances.

 

Budget/Fiscal Impact:  Funding is available in the approved FY 2025 Park Maintenance and Capital Improvement Millage budget and the Parks and Recreation fund balance. A 10% construction contingency ($53,399.00) is requested to cover potential contract change orders to be approved by the City Administrator. It is requested that the $587,389.00 contract and continency amount be approved for the life of the project without regard to fiscal year.

 

The Park Advisory Commission recommended approval of this contract at their February 25, 2025 meeting.

Whereas, Enhancements to Allmendinger Park have been identified as part of ongoing efforts to improve accessibility and implement neighborhood park capital improvements;

 

Whereas, The Allmendinger Park Improvements Project includes the installation of accessible parking spaces, new entrance and pathway pavement, fencing, grills and stormwater improvements;

 

Whereas, Parks staff solicited proposals through the City’s Procurement Unit and on December 10, 2024, six proposals were received for this work;

 

Whereas, E.T. Mackenzie Company received the highest score among the proposals reviewed by the selection committee, with a with a proposed total of $533,990.00 to complete the Project;

 

Whereas, E.T. Mackenzie Company is able to meet the project requirements and has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination, Prevailing Wage, and Living Wage Ordinances;

 

Whereas, Funding for this project is available from the approved Park Maintenance and Capital Improvement Millage Fund; and

 

Whereas, The Park Advisory Commission recommended approval of this contract at their February 25, 2025 meeting;

 

RESOLVED, That City Council approve a construction contract with E.T. Mackenzie Company in the amount of $533,990.00 for the Allmendinger Park Improvements Project (RFP 24-56).

 

RESOLVED, That a contingency amount of $53,399.00 (10%) be established within the project budget to cover potential contract change orders for the life of the project without regard to fiscal year and that the City Administrator be authorized to approve additional change orders to the construction contract with E.T. Mackenzie Company not to exceed the contingency amount in order to satisfactorily complete this project;

 

RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project.
