Resolution to Approve a Construction Contract with Weiss Construction Co., LLC in the amount of $1,910,734.00 for the Valve and Finished Water Tank & Reservoir Improvements Project (CRFP 22-53)
Memorandum
This memorandum and resolution requests approval to award a construction contract with Weiss Construction Co. LLC in the amount of $1,910,734.00 for the Valve and Finished Water Tank & Reservoir Improvements Project (CRFP 22-53).
The City of Ann Arbor Water Treatment Plant (WTP) operates with infrastructure of various ages, dating back to 1938. Many of the WTP valves and piping are over 50 to 70 years old. Major improvement projects in the 1960s replaced valves that are critical for isolation of reservoir sections and raw water supply and are approaching 60 years old. As a result of on-going condition assessments and evaluations, several of these valves have been identified as in immediate need of replacement, including associated valve vault improvements for safe access and operation. In addition, portions of filter effluent pipe installed in the 1960s was found to have extreme corrosion is in urgent need of specialty spot repair.
The WTP also operates and maintains several finished water outstation pump stations and storage facilities of varying age throughout the distribution system. The finished water storage facilities are inspected every five (5) years to assess condition and identify any deficiencies with the Michigan Safe Drinking Water Act as identified by the Michigan Department of Environment, Great Lakes, and Energy (EGLE).
The scope of this project includes replacement of aging and inoperable critical valves, associated access vault and structural repairs, filter effluent pipe repairs, as well as improvements at Manchester Elevated Tank and North Campus (Plymouth Rd) Elevated Tank to meet requirements of Rule 325.11112(c). The proposed improvements are necessary to assure operational reliability of the City’s WTP infrastructure and satisfy EGLE compliance request. This project is programmed in the City’s Capital Improvements Plan (UT-WS-22-01 and UT-WS-23-01).
Solicitation of Proposals
Water Treatment Services Unit staff supervised the creation of plans and contract documents and solicited proposals for construction of the project through the City’s Procurement Unit. On July 19, 2022, the City received one (1) proposal for this work. A selection committee comprised of Water Treatment Services staff reviewed the proposal and determined that the respondent provided complied with the criteria provided in ORD-21-41, adopted by Council on January 3, 2022:

After evaluation of the bid, staff has determined that Weiss’ bid is responsible, and it is in line with the construction cost estimate. Therefore, WTSU recommends approving the Contract for these services to Weiss Construction Co. LLC.
Due to budget constraints, some valve replacement scope and the work associated with North Campus and Liberty reservoirs was removed and will be programmed for the future. The awarded scope was modified to reduce the contract total to $1,910,734.00.
Budget/Fiscal Impact: This project is included in the Capital Improvements Plan (UT-WS-22-01 and UT-WS-23-01) funding is available Water Supply System Capital Improvement Budget for and will be included in future Fiscal Year Capital Budget if so, approved by Council.
Weiss Construction Co. LLC submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances.

Whereas, The Water Treatment Plant is comprised of critical infrastructure, including several critical valves, associated structures, and piping systems that have reached the end of their life and require replacement;
Whereas, EGLE compliance deficiencies were identified in the last round of Finished Water Storage Facility inspections;
Whereas, The Valve and Finished Water Tank & Reservoir Improvements Project will ensure that critical valves and piping are reliable and provide required level of service, and includes work to meet compliance at the WTP reservoir, Manchester Elevated Tank and North Campus (Plymouth Rd) Elevated Tank;
Whereas, The City recognizes the benefits of improvements to its critical water system infrastructure;
Whereas, Competitive bids were solicited by Procurement on July 19, 2022 (CRFP 22-53) and the bid received from Weiss Construction Co. LLC has been evaluated as a responsible bid in the amount of $1,910,734.00;
Whereas, The Valve and Finished Water Tank & Reservoir Improvements Project is included as a project in the Capital Improvement Plan;
Whereas, Funding for this work is available in the approved Water Supply System Capital Budget and will be included in future Fiscal Year Capital Budgets if so, approved by Council; and
Whereas, Weiss Construction Co. LLC has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances;
RESOLVED, That City Council approve the Construction Contract for the Valve and Finished Water Tank & Reservoir Improvements Project to Weiss Construction Co. LLC in the amount of $1,910,734.00;
RESOLVED, That a contingency in the amount of $191,000.00 be established within the project budget, and that the City Administrator be authorized to approve change orders not to exceed that amount;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney;
RESOLVED, That the City makes the following declaration for the purpose of complying with the reimbursement rules of Treas. Reg. 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Valve and Finished Water Tank & Reservoir Improvements Project with proceeds of Bonds; and
RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution including execution of any change orders that do not exceed the contingency amount.
