Resolution to Approve a Construction Contract with Z Contractors, Inc. for the 2190 South State Street Retaining Wall Replacement Project, RFP 23-11 ($179,746.05).

Memorandum

Attached for your review and approval, please find a resolution to approve a construction contract between the City of Ann Arbor and Z Contractors, Inc. in the amount of $ $179,746.05 for the 2190 S. State Street Retaining Wall Replacement Project (RFP 23-11).

 

The scope of this project is to replace the failing, city-owned timber retaining wall with a modular block retaining wall. The construction of the project is scheduled to occur between July and October of 2023. No work will occur during the week of Art Fair, and pedestrian access will remain open.

 

Engineering staff supervised the creation of plans and contract documents and issued a request for proposals for the project through the City’s Procurement Unit. On April 25, 2023, one proposal from Z Contactors, Inc. was received for this work. A selection committee comprised of Public Services staff evaluated the proposal based on the criteria in ORD-21-41:

                     Schedule of Pricing/Cost (20%)

 

The original RFP (23-11) included the installation of a new stone-veneer retaining wall, located at Geddes Ave and Onondaga. The total proposed cost for this wall greatly exceeded the engineer’s estimate and budget. Engineering staff reviewed the proposal and determined to remove the Geddes wall from the project, re-design it, and bid it separately, for construction in 2024. Because Z Contractors was the sole proposer, an updated bid form of only items pertaining to 2190 South State Street wall was negotiated with Z Contractors. The new proposal was reviewed and found to be reasonable. Therefore, staff recommends approving a contract with Z Contractors, Inc. for this project.

 

Z Contractors complies with the City’s Non-Discrimination and Living Wage ordinances.

 

Budget/Fiscal Impact:  This project is included in the FY2024-2029 Capital Improvements Plan (TR-OT-24-07).  The estimated total cost of the project is $250,000. Funding for the project is available in the approved Major Street Fund Capital Budget.

Whereas, Based on evaluation by City Staff, the existing City-owned timber retaining wall at 2190 South State Street is failing and in need of replacement;

 

Whereas, Funding for the project is available from the approved Major Street Fund Capital Budget;

 

Whereas, The City of Ann Arbor received one proposal for this work on February 16, 2023 and Z Contractors, Inc. and after review, staff recommends approval of a construction contract with Z Contractors, Inc. for this project; and

 

Whereas, It is now necessary to enter into a contract with Z Contractors, Inc. for the performance of this work;

 

RESOLVED, That City Council approves a construction contract with Z Contractors, Inc. in the amount of $179,746.05 for the 2190 South State Street Retaining Wall Replacement Project (RFP 23-11);

 

RESOLVED, That a contingency amount of $18,000.00 be established within the project budget and that the City Administrator be authorized to approve construction change orders not to exceed that amount, in order to satisfactorily complete this project;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project.
