Memorandum

Attached for your review and action is a resolution to approve a construction contract with Fonson Company, Inc. in the amount of $835,765.92 for the Fuller Park parking lot and Border to Border Trail improvements project.

 

Project Description

This project will reconstruct the asphalt parking lot at Fuller Park. The existing parking lot has deteriorated and is in need of replacement, as determined both by park staff and a conclusive soil boring evaluation. Improving this highly used parking lot will help to better support Fuller Park, a busy park facility that includes an outdoor pool, playground, playing fields, summer camps, and the GIVE 365 offices. This project will also improve access to Fuller Park and its amenities.

 

This project also includes reconstruction and expansion of a 0.4-mile segment of the Border to Border (B2B) Trail that spans from Maiden Ln. to Cedar Bend Dr. south of Fuller Park. This project would expand the current 8’ wide trail to 10’ to meet national trail standards. This is a heavily utilized section of the B2B trail and key non-motorized transportation corridor, and its expansion and improvement will improve use by park users and non-motorized commuters.

 

Construction of the parking lot is anticipated to be completed by May 23, 2025, in order to align with the summer schedule of the Fuller Park pool. Construction of the B2B trail is anticipated to be completed by Winter 2025.

 

Solicitation of Bids:

Park staff solicited construction proposals through Request for Proposals #24-54 through the City’s Procurement Unit. Project plans and specifications were distributed electronically to contractors, subcontractors, and suppliers through the City of Ann Arbor’s procurement website and MITN.info. 

 

On October 17, 2024, three proposals were received and opened. The highest scoring proposal was from Fonson Company, Inc., in the amount of $835,765.92. A summary of the scores for the proposals is attached here.

 

Fonson Company, Inc. is a prequalified contractor with MDOT. They have verified experience in Washtenaw County with road reconstruction, installing utilities, and infrastructure repair. Fonson Company, Inc. can meet the project requirements and has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances.

 

Therefore, Staff recommends that City Council approve a construction contract with Fonson Company, Inc. in the amount of $835,765.92 for construction of the Fuller Park Parking Lot Improvements project. A 10% construction contingency of $83,576.59 is requested to cover potential contract change orders to be approved by the City Administrator. It is requested that a $919,342.51 contract and contingency amount be approved for the life of the project without regard to fiscal year.

 

The Park Advisory Commission unanimously recommended approval of this contract at their November 19, 2024 meeting.

 

Budget/Fiscal Impact

The Fuller Park parking lot reconstruction will be funded solely by the City. Funding for the parking lot scope of work ($482,593.10) is available from the Park Maintenance and Capital Improvement Millage Fund.

 

The B2B trail reconstruction scope of work ($353,172.82) is jointly funded by the City and the Washtenaw County Parks and Recreation Commission (“County”). Each organization will be responsible for 1/2 of the cost of the B2B Trail scope of work. For the City’s portion of the costs, estimated at $176,586.41, funding is available from the Park Maintenance and Capital Improvement Millage Fund. The County will provide the remaining $176,586.41 on a reimbursement basis with the City.

RESOLVED, That City Council approve a construction contract with Fonson Company, Inc. in the amount of $835,765.92 for construction of the Fuller Park Parking Lot Improvements project (RFP 24-54);

 

RESOLVED, That a contingency amount of $83,576.59 (10%) be established within the project budget to cover potential contract change orders for the life of the project without regard to fiscal year and that the City Administrator be authorized to approve additional change orders to the construction contract with Fonson Company, Inc., not to exceed the contingency amount in order to satisfactorily complete this project;

 

RESOLVED, That City Council appropriate $176,586.00 to the FY 2025 Parks & Recreation Park Maintenance and Capital Improvement Millage expenditure budget with the source of revenue being reimbursement from Washtenaw County Parks and Recreation Commission for this project;

 

RESOLVED, That all amounts herein are without regard to fiscal year;

 

RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project.
