Resolution to Vacate a Water Main Easement at 1300 S. Maple Road from Grace Bible Church of Ann Arbor, Michigan (8 Votes Required)

Memorandum

This easement is given pursuant to the Grace Bible Church Site Plan approved by City Council on November 15, 2021, R-21-417 and also in conjunction with the Midtown Ann Arbor site plan approved by City Council on November 8, 2018, R-18-450.

 

City Council accepted Water Main Easement ‘B’ on December 18, 2023, R-23-452.

 

Water Main Easement “B” described below is intended to supersede and replace the portion of the existing easement described as Water Main Easement “A” which was granted in Liber 5235, page 525. All other portions of the easement as described in Liber 5235, page 525 shall remain in full force and effect. City Council approval is needed to vacate Water Main Easement ‘A’. A certified copy of this resolution will be recorded at the Washtenaw County Register of Deeds to evidence the vacation of the portion of the easement recorded in Liber 5253, page 525.

Whereas, Grace Bible Church of Ann Arbor, Michigan, a Michigan nonprofit corporation, is the owner of property commonly known as 1300 S. Maple Road, Ann Arbor, Michigan 48103;

 

Whereas, Grantor wishes to vacate a portion of the water main easement recorded in Liber 5253, page 525 described as:

 

WATER MAIN EASEMENT VACATION 'A': A 40 foot wide easement for Water Main Vacation, over part of the Northeast 1/4 of Section 36, Town 2 South, Range 5 East, City of Ann Arbor, Washtenaw County, Michigan, the centerline of which is described as: Commencing at the East 1/4 corner of said Section; thence N01°19'00"W 735.15 feet along the East line of said Section and the centerline of S. Maple Road; thence S88°41'00"W 95.54 feet; thence Southwesterly 359.57 feet along a 383.00 feet curve to the left, said curve having a central angle of 53°47'25", and a chord bearing S61°47'19"W 346.51 feet to the Point of Beginning of said centerline; thence N18°03'23"W 148.66 feet; thence N40°33'23"W 129.74 feet; thence N85°33'23"W 41.64 feet to the Point of Ending of said centerline. The sidelines of said easement to begin on the South parcel line and meet at the angle points;

 

Whereas, All other portions of the easement as described in Liber 5235, page 525, shall remain in full force and effect;

 

Whereas, Grantor has signed a grant of easement for water main and appurtenances as described in Water Main Easement ‘B’ below and on the attached map that is intended to supersede and replace Water Main Easement Vacation ‘A’:

 

WATER MAIN EASEMENT 'B': A 40 foot wide easement for Water Main, over part of the Northeast 1/4 of Section 36, Town 2 South, Range 5 East, City of Ann Arbor, Washtenaw County, Michigan, the centerline of which is described as: Commencing at the East 1/4 corner of said Section; thence N01°19'00"W 735.15 feet along the East line of said Section and the centerline of S. Maple Road; thence S88°41'00"W 95.54 feet; thence Southwesterly 359.57 feet along a 383.00 feet curve to the left, said curve having a central angle of 53°47'25", and a chord bearing S61°47'19"W 346.51 feet to the Point of Beginning of said centerline; thence N54°40'49"W 61.55 feet; thence S87°40'57"W 87.05 feet; thence N14°02'39"W 86.14 feet; thence N31°03'36"W 114.14 feet to the Point of Ending of said centerline. The sidelines of said easement to begin on the South parcel line and meet at the angle points; and

 

Whereas, City Council accepted the grant of easement described as Water Main Easement ‘B’ on December 18, 2023, R-23-452;

 

RESOLVED, That City Council approves the vacation of Water Main Easement ‘A’;

 

RESOLVED, That a certified copy of this resolution be recorded at the Washtenaw County Register of Deeds to evidence the vacation of Water Main Easement Vacation ‘A’; and

 

RESOLVED, That all other portions of the easement as described in Liber 5235, page 525 shall remain in full force and effect.
