Resolution to Approve Amendment No. 4 to the Professional Services Agreement with CDM Michigan Inc. ($100,000.00) for Technical Engineering Services

This memorandum and resolution request approval of Amendment No. 4 to the professional services agreement for technical engineering services with CDM Michigan Inc. Council approved a professional services agreement for $75,000.00 with CDM in June 2005 as part of Resolution No. R-236-6-05, Amendment No. 1 for $75,000.00 in September 2006 as part of Resolution No. R-409-9-06, Amendment No. 2 for $140,000.00 in September 2007 as part of Resolution No. R-450-9-0, and Amendment No. 3 for $100,000.00 in July 2009 as part of Resolution No. R-09-299
The City is seeking to extend the professional services agreement with CDM Michigan Inc. to accommodate additional technical engineering service needs over the next two fiscal years. CDM Michigan Inc. is currently supporting the Water Treatment Services Unit in Public Services on numerous projects, including Distribution System Monitoring and the Lime Handling Improvements Projects. The services rendered to date on these projects have been very good.
It is therefore recommended that City Council approve Amendment No. 4 to the professional services agreement with CDM Michigan Inc. for $100,000.00, to provide Technical Engineering Services to the Water Treatment and Field Operations Services Units for FY12 and FY13.
CDM received Human Rights approval on May 22, 2010, and complies with the living wage ordinance.
These engineering services are to be funded from the approved FY12 and FY13 Water Supply System Fund, Sewage Disposal System Fund, Stormwater System Fund, Park Maintenance & Capital Improvement Millage, General Fund (Hydro), and Solid Waste Operations and maintenance budgets, if so approved by council. Additional funding is included in the FY12 and FY13 (if so approved by Council) capital budgets, for which services are rendered. Tasks will be assigned on as-needed basis to the appropriate fund.

Whereas, The City seeks to extend the Technical Engineering Services contract with CDM through the end of FY13;
Whereas, CDM has provided valuable service to the City using the Technical Engineering Services Contract over the past six years; and
Whereas, CDM has received Human Rights approval on May 22, 2010, and complies with the Living Wage Ordinance;
RESOLVED, That the Amendment No. 4 in the amount of $100,000.00 to the Professional Services Agreement with CDM is approved and that funds be available for the life of the project until expended without regard to fiscal year;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute Amendment No. 4 to the professional services agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney;
RESOLVED, That funds for this project are available in the FY12, and FY13 if so approved by Council, Capital Projects Budget and are advanced from the Water Supply System Operating Fund Balance to be repaid pending the sale of water revenue bonds; and
RESOLVED, that the City make the following declaration for the purpose of complying with the reimbursement rules of Treas. Reg. 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds.
