Attached for your review is a resolution to approve a $143,500.00 contract between Aquatic Source, LLC and the City of Ann Arbor for the Mack Indoor Pool
Improvements Project.
Budget/Fiscal Impact
Funding is available from two sources:
1. $35,875.00 from revenue received from the Ann Arbor Public Schools, paid annually into a capital facilities balance sheet account earmarked for Mack Pool.
2. $129,125.00 in the approved FY2019 Parks Maintenance and Capital Improvements Millage budget.
The new filtration, UV treatment and pump system are anticipated to reduce General Fund operating costs by approximately $3,000.00 annually. The new system will provide more efficient back washing of the filter, resulting in decreased water usage, chemical treatment and pool heating demands. Also, the main pool pump will receive a variable frequency drive, allowing for a reduction in electrical demand when the pool is not in use.
Project Description
The Parks and Recreation Open Space Plan identifies maintenance of the recreation facilities as a priority. Following a recent inspection of the pool facilities, Mack Pool was identified as having mechanical systems that are approximately 29 years old, and at risk of a major failure. This project will replace the major mechanical components of the pool including the sand filter and main pump, as well as add a low pressure UV treatment system to improve the pool atmosphere. Minor improvements will also be made to the existing tile surfaces within the pool.

The contract documents for the project were bid through the City’s Procurement Unit following standard procedures. On April 18, 2019, three bids were received for this work. The lowest responsible bid was from Aquatic Source, LLC in the amount of $143,500. Attached is a tabulation of the bids received for the project.
Staff is recommending award of a contract to Aquatic Source, LLC in the amount of
$143,500.00 to for the Mack Indoor Pool Improvements Project. A 15% construction contingency ($21,500.00) is requested to cover potential contract change orders to be approved by the City Administrator. It is requested that a $165,000.00 contract and contingency amount be approved for the life of the project without regard to fiscal year.
Aquatic Source, LLC has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination, Prevailing Wage and Living Wage Ordinances.

Whereas, The City of Ann Arbor received three bids for this work on April 18, 2019, and Aquatic Source, LLC of Brighton, Michigan was the low responsible bidder with a bid amount of $143,500.00;
Whereas, It is now necessary to enter into a contract with Aquatic Source, LLC for the performance of this work; and
Whereas, Aquatic Source, LLC has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination, Prevailing Wage and Living Wage Ordinances;
RESOLVED, That a contract with Aquatic Source, LLC of Brighton, Michigan in the amount of $143,500.00 be approved;
RESOLVED, That City Council authorizes the appropriation of $35,875.00 from a General Fund balance sheet account dedicated to Mack Pool capital facilities improvements and funded through annual payments from the Ann Arbor Public Schools to partially fund the contract budget and construction contingency;
RESOLVED, That City Council increase the Parks Maintenance and Capital Improvements Millage budget by $35,875.00 for this project, bringing the total project budget, including contingency, to $165,000.00;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract with Aquatic Source, LLC in the amount of $143,500.00 in the form on file with the Purchasing Agent, following approval as to substance by the City Administrator, and approval as to form by the City Attorney;
RESOLVED, That a contingency amount of $21,500.00 be established, and the City Administrator be authorized to approve change orders to the contract with Aquatic Source, LLC up to $21,500.00, in order to satisfactorily complete the project;
RESOLVED, That the total $165,000.00 contract and contingency amount be available for the life of the project until expended without regard to fiscal year; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution to allow the work of the project to proceed without delay.
