Below for your review and action is a resolution to approve the purchase of the vacant property located at 2725 Kimberley Road, Ann Arbor, MI 48104 (approximately 0.23 acres), Tax Parcel 09-12-03-305-069 in fee title for $197,000.00 from the Seller, Richard L. Smith and Susanne L. Smith, on the terms set forth in the proposed Purchase Agreement (see attached).
The parcel in question is currently vacant. The Gravel Roads Drainage Study has recommended a drainage improvement to address flow and conveyance in the vicinity near Molin Nature Area. This parcel is adjacent to the nature area and acquiring it would provide access and conveyance for future drainage improvements.
In compliance with the requirements of Code Section 1:321, the City obtained an appraisal of the property in September 2026.
Budget/Fiscal Impact: Funds for this property purchase are available in the approved Stormwater Fund budget. Funding for the purchase will include the purchase price plus due diligence and closing costs for a total amount not to exceed $217,000.00.

Whereas, Acquisition of the parcel at 2725 Kimberley Road provides opportunities for improvement to the City’s stormwater management system;
Whereas, The City obtained an appraisal of the parcel in compliance with Code Section 1:321, and City staff and the property owners have engaged in negotiations for the purchase and sale of the property and have agreed on a purchase price of $197,000.00;
Whereas, City staff recommend approval of the proposed Purchase Agreement for the property at a price of $197,000.00, plus due diligence and closing costs not to exceed $20,000.00, and on the terms and conditions set forth therein;
Whereas, There are sufficient funds in the Stormwater Fund to cover the cost of this property purchase plus the estimated due diligence and closing costs; and
RESOLVED, That City Council approve the purchase of the real property located at 2725 Kimberley Road, Ann Arbor, MI 48104 (Tax Parcel 09-12-03-305-069) in fee title for $197,000.00 from the Seller, Richard L. Smith and Susanne L. Smith, plus due diligence and closing costs not to exceed $20,000.00 on the terms set forth in the proposed Purchase Agreement;
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the Purchase Agreement for the property after approval as to substance by the City Administrator and as to form by the City Attorney; and
RESOLVED, That the City Administrator is authorized to take all appropriate action to implement this resolution, including the determination of satisfactory due diligence and execution of all appropriate documents.
