Resolution to Accept a Water Main Easement at 3401 Platt Road from the Ann Arbor Housing Commission and Swift Lane Limited Dividend Housing Association Limited Partnership (8 Votes Required)

Memorandum

This is an easement for a new water main per the Plat Road East Planned Project site plan also known as the Swift Lane Development located at 3401 Platt Road. The property is owned by the Ann Arbor Housing Commission (AAHC) and the Swift Lane Limited Dividend Housing Association Limited Partnership is the ground lessee on the land. Both entities have executed the easement. This easement is in standard form and is conveyed without cost to the City.

 

Acceptance of this easement is recommended.

Whereas, the Ann Arbor Housing Commission, a Michigan public body corporate, is the owner and the Swift Lane Limited Dividend Housing Association Limited Partnership, a Michigan limited partnership, is the ground lessee, of property commonly known as 3401 Platt Road, Ann Arbor; and

 

Whereas, the Ann Arbor Housing Commission and Swift Lane Limited Dividend Housing Association Limited Partnership have signed a grant of easement for water mains and appurtenances, described as:

 

Easement 1

Commencing at the NW Corner of Lot 69 of “Wagner McComb Boulevard Gardens” Liber 3 of Plats, Page 19, Washtenaw County Records; thence S00°00'00'W 96.68 feet along the East right-of-way line of Platt Road to the Point of Beginning;

thence S88°59'42"E 113.92 feet;

thence S01 °00'18'W 40.00 feet;

thence N88°59'42'W 113.22 feet;

thence N00°00'00"E 40.01 feet along the East right-of-way line of Platt Road to the Point of Beginning. Being a part of "Wagner McComb Boulevard Gardens" Subdivision and the NW 1/4 of Section 11, T3S, R6E, City of Ann Arbor, Washtenaw County, Michigan.

 

Easement 2

Commencing at the NW Corner of Lot 69 of “Wagner McComb Boulevard Gardens” Liber 3 of Plats, Page 19, Washtenaw County Records; thence S00°00'00"W 295.04 feet along the East right-of-way line of Platt Road to the Point of Beginning;

thence S89°20'53"E 123.67 feet;

thence S00°39'07'W 40.00 feet;

thence N89°20'53'W 123.22 feet;

thence N00°00'00"E 40.00 feet along the East right-of-way line of Platt Road to the Point of Beginning. Being a part of 'Wagner McComb Boulevard Gardens" Subdivision and the NW 1/4 of Section 11, T3S, R6E, City of Ann Arbor, Washtenaw County, Michigan.

 

RESOLVED, That the City of Ann Arbor hereby accepts this grant of easement.
