An Ordinance to Amend Section 1:17 (Code Violation Citations) of Chapter 1 of Title I and Section 8:458 of Chapter 104 (Energy and Water Benchmarking) of Title VIII (ORD-24-27)
Memorandum
In November 2019, Ann Arbor City Council unanimously adopted a Climate Emergency Declaration committing to charting a path for how the entire Ann Arbor community could achieve carbon neutrality by the year 2030. In June 2020, City Council unanimously adopted the A2ZERO Carbon Neutrality Plan (“A2ZERO”), Ann Arbor’s plan for achieving a just transition to community-wide carbon neutrality by 2030.
In furtherance of the City’s A2ZERO goals, City Council has passed several ordinances originating from the Office of Sustainability and Innovations (“OSI”) that require enforcement, including the Energy and Water Benchmarking Ordinance (Chapter 104 of Title VIII) (Ord. No. 21-30), the Home Energy Rating Disclosure Ordinance (Chapter 102 of Title VIII) (ORD No. 23-26), and the Leaf Blowers Ordinance (Chapter 75 of Title VI) (Ord No. 23-35).
The attached proposed ordinance amendment gives enforcement authority to OSI for chapters relating to its work, as well as cleans up the rest of Section 1:17 of Chapter 1 to reflect the City’s current organizational chart and to update the chapters that each service unit is authorized to enforce. The proposed ordinance amendment also updates the Energy and Water Benchmarking Ordinance to remove reference to the specific units that may enforce it, allowing anyone authorized under Section 1:17 of Chapter 1 to enforce.
Budget/Fiscal Impact: The proposed changes to Section 1:17 of Chapter 1 of Title I and Section 8:458 of Chapter 104 of Title VIII will not have any financial implications for the City. The changes are administrative and will make it easier to identify who is authorized to enforce which chapters within the City.
