Resolution to Approve a Construction Contract with E.T. MacKenzie Company For Public Works On-Call Construction Services in the Amount of $500,000.00 for a Period of Two Years (RFP# 23-55)

Memorandum

Attached for your approval is a resolution to approve a construction contract with E.T. MacKenzie Company for up to $500,000.00 for on-call construction services for two (2) years with an option to extend the contract one (1) additional two (2) year period. This contract is for emergency response work exceeding City capabilities, such as complicated sewer or water main repairs, and for small infrastructure improvement projects that fall below the threshold of Capital Improvement Plan Projects. 

 

RFP# 23-55 was advertised on the City’s website and on the Michigan Inter-Governmental Trade Network (MITN) website. One (1) proposal was received and publicly opened on October 10, 2023. A selection committee comprised of Public Works staff reviewed the proposals and determined the proposal from E.T. MacKenzie Company provided value based on the criteria in ORD-21-41, adopted by Council on January 3, 2022:

 

                     Qualifications, Experience, & Accountability (20%)

                     Workplace Safety (20%)

                     Workforce Development (20%)

                     Social Equity & Sustainability (20%)

                     Schedule of Pricing/Cost (20%)

 

Therefore, staff recommends awarding the contract to E.T. MacKenzie Company for this project.  E.T. MacKenzie Company complies with the City’s Non-Discrimination and Living Wage ordinances.

 

Budget/Fiscal Impact:  Funding is available in the approved FY24 Public Services Operation and Maintenance and Capital budgets and will be available in subsequent budgets if approved by Council.  Funding will be allocated to the appropriate funding source based on scope of individual tasks performed under this contract.

Whereas, The Public Works Unit requires on-call contractors capable of assisting the City with emergency projects and infrastructure work below the threshold of Capital Improvement Projects;

 

Whereas, Public Works issued RFP# 23-55 and one (1) proposal was received and publicly opened on October 10, 2023;

 

Whereas, The proposal was reviewed by Procurement and evaluated by Public Works staff, and after review, staff recommends award of the contract to E.T. MacKenzie Company; and

 

Whereas, E.T. MacKenzie Company complies with the City’s Living Wage and Non-Discrimination Ordinances;

 

RESOLVED, That the City Council approve a two (2) year construction contract with E.T. MacKenzie Company in an amount of up to $500,000.00 for on-call construction services;

 

RESOLVED, That the City Administrator be authorized to extend the contract for one (1) additional two (2) year period subject to a mutually agreeable price adjustment not to exceed 3% and subject to City Council’s appropriation of commensurate funds in subsequent years,

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney, and approval as to substance by the City Administrator; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution including approval of needed Traffic Control Orders, night work authorizations, and other similar administrative approvals to allow the work under the contracts to proceed without delay.
