Memorandum
Attached for your review and approval is a resolution for Amendment Number 5 to the Professional Services Agreement with Tetra Tech, Inc. for environmental consulting services for the Ann Arbor Landfill Monitoring and Maintenance Program, through June 30, 2023. The total additional amount requested for FY22 and FY23 is $380,111.00 with a contingency of $40,000.00.
Resolution R-17-255 requested $270,511.00 with a contingency of $27,000.00 for Landfill Monitoring and Maintenance for FY 17 through FY19. Resolution R-19-319 requested $351,124.00 with a contingency of $40,000.00 for Landfill Monitoring and Maintenance for FY 20 through FY21. Resolution R-20-278 requested $124,907.73 for additional repairs and maintenance to the landfill.
The City has partnered with Tetra Tech since 2007, as part of our ongoing Ann Arbor Landfill Monitoring and Maintenance Program. This program provides the City a professional environmental consultant to perform the tasks necessary to satisfy the monitoring requirements of the Michigan Department of Environment, Great Lakes and Energy (EGLE) for groundwater and gas in the vicinity of the Ann Arbor Landfill.
Historical Knowledge
Tetra Tech, Inc. was founded in 1966 and has more than 50 years of experience and is a leading provider of consulting and engineering services within the United States, the Company supports government and commercial clients by providing innovative solutions focused on water, environment, infrastructure, resource management, and energy. Since 2007, Tetra Tech, Inc. has managed the City’s landfill Inspections, purge wells, purge well discharge line, repair and maintenance, Preputial Care Fund calculations and updates, landfill flow meter telemetry, hydrogeologic monitoring plan (HMP), technical memos for the 1,4 dioxane investigation, and quarterly gas monitoring reports. This institutional knowledge is invaluable to the City in the compliance and maintenance of the Ann Arbor Landfill (AALF).
Landfill Remedial Action Plan (RAP)
The City of Ann Arbor has implemented a remedial action plan (RAP) to address offsite groundwater impact from 1,4-doxane and vinyl chloride as a result of historic landfill operations at the AALF. Tetra Tech, Inc. is currently leading technical discussions with the Michigan Department of Environment, Great Lakes and Energy (EGLE) and updating the City Ann Arbor Offsite Remedial Action Plan. The ongoing discussions with EGLE require subject matter experts with long-term historical knowledge of the AALF and the requirements dictated by the state and federal government. To date, EGLE has not provided the City with final requirements for the RAP, requiring the need to retain Tetra Tech, Inc. as a contractor to support this ongoing work.
Feasibility Study Landfill Power Generation
The Feasibility study will consider using existing landfill power generation equipment (assuming the City purchases the Aria/EPP equipment) and take over the operation of the system including the interconnect with Detroit Edison, then the City would wheel electricity to City owned electric vehicle charging stations. The use of green electricity for vehicle fueling is paramount for this feasibility study because it allows the City to capture numerous environmental attributes and funding.
Landfill Solar Due Diligence
The City Sustainability Department is working with DTE on implementation of solar panels on the general landfill fill property, as part of that, additional investigations and reports are needed in order to provide the documentation needed to DTE.
Ecological: Conduct a wetland delineation in accordance with United States Army Corp of Engineers manual; complete a review of threatened and endangered (T&E) plants and animals; determine if roost trees for T&E bats are present in the solar footprint and adjacent; provide report and concurrence from United States Fish and Wildlife Service. Complete a Joint Permit Application for wetland/water resource impacts for a culvert to cross Swift Run Drain (a regulated County Drain under Part 301 Inland Lakes and Streams) to access the southernmost fields. Investigate other permitting potentials including County Drain right-of-way and Part 91 soil erosion and sedimentation control.
Cultural: Complete a desktop evaluation and write a report of findings.
Environmental due diligence: Complete a Phase I ESA (Environmental Site Assessment) for the solar development properties. Costs are included for a Phase II ESA should it be necessary and includes two days of a drilling investigation - one day for temporary wells and one day for soil borings if needed. Pending Phase II ESA results and if necessary, a Baseline Environmental Assessment and Due Care Plan will be drafted and sent to EGLE (Environment, Great Lakes and Energy) Remediation and Redevelopment Division.
Budget/Fiscal Impact: Funding for this program has been budgeted in the FY 22 Solid Waste Operation and Maintenance budget and will be made available in the FY23 Solid Waste Operation and Maintenance budget if so, approved by Council.
Funding for the Feasibility Study Landfill Power Generation and the DTE Solar Due Diligence is available in the FY 22 General Fund and will be made available in the FY23 General Fund budget if so, approved by Council.

Whereas, It is necessary to remain in compliance with Michigan Department of Environment Great Lakes and Energy regulations to maintain and repair as needed the Ann Arbor Landfill;
Whereas, Tetra Tech, Inc. has managed the Ann Arbor Landfill inspection, maintenance, and monitoring since 2007 and has demonstrated the required experience, qualified professionals, and provided a competitive fee schedule for the required services;
Whereas, It is necessary to retain the services of a professional engineering firm to assist the City with the routine repairs, and oversight of the overall landfill system maintenance at the Ann Arbor Landfill;
Whereas, Amendment #5 to the Professional Services Agreement with Tetra Tech, Inc. is necessary to perform ongoing identified tasks related to the landfill and the Office of Sustainability’s tasks to perform the Feasibility Study Landfill Power Generation and Landfill Solar Due Diligence;
Whereas, Tetra Tech, Inc. is in compliance with the requirements of the City’s Non-Discrimination and Living Wage ordinances;
Whereas, Funding for this program has been budgeted in the FY 22 Solid Waste Operation and Maintenance budget and will be made available in the FY23 Solid Waste Operation and Maintenance budget if so, approved by Council; and
Whereas, Funding for the Feasibility Study Landfill Power Generation and the DTE Solar Due Diligence will be made available in the FY 22 General Fund and the FY23 General Fund in the operating budget if so, approved by Council;
RESOLVED, That City Council approves Amendment Number 5 to the professional services agreement with Tetra Tech, Inc. for the additional amount of $380,111.00 for the environmental consulting services for the Ann Arbor Landfill Monitoring and Maintenance Program and the Sustainability Department’s Feasibility Study Landfill Power Generation and Landfill Solar Due Diligence identified tasks;
RESOLVED, That a contingency in the amount of $40,000.00 be established and that the City Administrator be authorized to approve change orders to the agreement with Tetra Tech, Inc. not to exceed that amount; and
RESOLVED, That City Council authorizes the City Administrator to take necessary administrative actions to implement this resolution.
