Memorandum
Approval of this ordinance will zone this property TC1 (Transit Corridor) with conditions proposed by the applicant to limit building height.
A proposal to rezone an approximately 41-acre site from R3 (Multiple Family), R4 (Multiple Family), and PL (Public Land) districts to TC1 (Transit Corridor), with the proposed height conditions as follow: buildings between 30 and 300 feet from properties adjacent to Woodbury Gardens that are zoned residential shall be subject to a 35-foot height limit. Buildings between 300 and 600 feet from properties adjacent to Woodbury Gardens that are zoned residential shall be subject to an 85-foot height limit. Buildings more than 600 feet from properties adjacent to Woodbury Gardens that are zoned residential will apply the regular TC1 height limit of 120 feet, because the proposed designation is consistent with the overarching goals of the 2026 Comprehensive Plan. A portion of the site at 1310 Wisteria is proposed to construct three seven-story buildings.
Petition Summary:
An area plan or site plan is required when an amendment to the City Zoning Map is proposed [Chapter 55 5.29.7]. In this case, the petitioner has proposed amending the City Zoning Map TC1 (Transit Corridor) with a site plan for a portion of the site. The site plan will be presented for approval with the second reading of the zoning.
The site plan proposes the construction of three seven-story buildings containing 342 dwelling units, and a five-level parking garage. An administrative land transfer is required and will be considered separately. The site is roughly in the center of the Woodbury Gardens apartment development.
It is rare to see rezoning petitions from PL (Public Land) to another zoning designation, as is included here. The area in question is a strip of land immediately west of Woodbury Drive. This area is across Woodbury Drive from Frisinger Park but is not part of the publicly owned park. If this area is included in the proposed rezoning, it will apply the TC1 development standards to the site, where no requirements currently apply.
The City Planning Commission at its meeting of July 7, 2026 recommended approval of this request.
