Resolution to Approve Amendment No. 1 to the Professional Services Agreement with ASTI Environmental for Gallup Bridge Mussel Relocation ($16,000.00)

Memorandum

Attached for your review and action is a resolution to approve Amendment No. 1 with ASTI Environmental in the amount of $16,000.00 for a new total contract amount of $79,000.00 for the relocation and monitoring of endangered mussels in Gallup Park.

 

The Huron River within Ann Arbor is regulated by the Michigan Department of Natural Resources (MDNR), the Michigan Department of Environment, Great Lakes and Energy (EGLE), and the Washtenaw County Water Resources Commission (WCWRC). The new vehicle bridge constructed in Gallup Park is located within a section of river considered an MDNR Natural River within Ann Arbor. In-water construction impacts pose a risk to freshwater water mussels, including those under State and Federal protection. Therefore, these environmental regulatory agencies require the relocation of mussels prior to construction of the new Gallup Park vehicle bridge as part of their permit requirements.

 

A mussel survey conducted found mussels present on the site that were listed on the state's threatened and endangered species list. ASTI Environmental was contracted by the City to relocate and monitor mussels at the Gallup Bridge site. ASTI Environmental collected mussels in the area of impact at the Gallup Park bridge prior to construction and relocated them to a pre-approved site. EGLE required follow-up monitoring and a report to be submitted as part of permit requirements. Two additional monitoring days with divers were required for follow-up monitoring at $8,000.00 per day, increasing the original contract amount of $63,000.00 by an additional $16,000.00. The new contract amount will be $79,000.00.

 

Budget/Fiscal Impact:  Funding for this work is available from the Park Maintenance and Capital Improvement Millage Fund.

RESOLVED, That City Council approves Amendment No. 1 to the Professional Services Agreement with ASTI Environmental, increasing the total contract amount from $63,000.00 to $79,000.00;

 

RESOLVED, That the Mayor and City Clerk are authorized to sign the agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator is authorized to take all appropriate actions to implement this resolution, including signing all necessary documents and sub-agreements.
