Resolution to Approve the 3400 Dexter Road Annexation, 4.308 Acres, 3400 Dexter Road

Memorandum

Approval of this resolution will allow annexation of this property from Scio Township into the City.  The property is within the City’s water and sewer service area, and the current use is consistent with the adjacent zoning, land uses and comprehensive plan.  Council action on the proposed R4B (Multiple-Family Dwelling District) zoning and site plan will be scheduled after the annexation process is complete.

Whereas, The territory hereinafter described is located in the Township of Scio and is adjacent to the corporate limits of the City of Ann Arbor;

 

Whereas, 3400 DA LLC is the owner of said property;

 

Whereas, It is the desire of 3400 DA LLC to annex said territory to the City of Ann Arbor, pursuant to the provisions of Public Act 279 of 1909 or Public Act 359 of 1947 of the State of Michigan, as amended;

 

Whereas, Toll Northeast V Corp, as authorized agent for 3400 DA LLC, has submitted a site plan that is currently under review by staff; and

 

Whereas, An R4B Zoning and Site Plan will be forwarded to City Council after action from the Planning Commission and completion of the annexation process;

 

RESOLVED, That the following described lands and premises situated and being in the Township of Scio, Washtenaw County, Michigan, be detached from said Township and annexed to the City of Ann Arbor:

 

A PARCEL OF LAND BEING PART OF THE SOUTHWEST 1/4 OF SECTION 24, TOWN 2 SOUTH, RANGE 5 EAST, SCIO TOWNSHIP, WASHTENAW COUNTY, MICHIGAN, AND BEING DESCRIBED AS FOLLOWS:

 

COMMENCING AT THE CENTER POST OF SECTION 24, TOWN 2 SOUTH, RANGE 5 EAST, SCIO TOWNSHIP, WASHTENAW COUNTY, MICHIGAN; THENCE S89°01'25"W 1168.55 FEET (RECORDED AS N87°28'W 1167.93 FEET) ALONG THE EAST-WEST 1/4 LINE OF SAID SECTION 24; THENCE S01°46'00"E (RECORDED AS N01°44E) 71.12 FEET, ALONG THE WEST LINE OF "DEXTER AVENUE HILLS" SUBDIVISION, RECORDED IN LIBER 6, PAGE 49, WASHTENAW COUNTY RECORDS, TO THE POINT OF BEGINNING; THENCE S01°46'00"E (RECORDED AS N01°44E) 449.76 FEET, ALONG THE WEST LINE OF SAID "DEXTER AVENUE HILLS" SUBDIVISION; THENCE S88°14'00"W 76.24' FEET; THENCE S01°46'00"E 272.39 FEET (RECORDED AS 273.51 FEET) TO A POINT IN THE CENTER OF DEXTER-ANN ARBOR ROAD (VARIABLE WIDTH); THENCE N74°17'20"W 144.12 FEET ALONG THE CENTERLINE OF SAID DEXTER-ANN ARBOR ROAD; THENCE N15°42'40"E 40.00 FEET, TO A POINT ON THE NORTHERLY RIGHT OF WAY LINE OF SAID DEXTER-ANN ARBOR ROAD; THENCE THE FOLLOWING FIVE (5) COURSES ALONG THE NORTHERLY RIGHT OF WAY LINE OF SAID DEXTER-ANN ARBOR ROAD: N74°17'20"W 200.00 FEET, N15°42'40"E 20.00 FEET, N74°17'20"W 100.00 FEET, N15°42'40"E 15.00 FEET, AND N74°17'20"W 80.46 FEET, TO A POINT ON THE EASTERLY RIGHT OF WAY LINE OF M-14 (300 FEET WIDE); THENCE N46°34'05"E 741.69 FEET, ALONG THE EASTERLY RIGHT OF WAY LINE OF SAID M-14, TO THE POINT OF BEGINNING.
