Resolution to Approve an Agreement for Joint Recreation Programs with Ann Arbor Public Schools

Memorandum

Attached for your review and action is a resolution to approve an updated agreement regarding joint recreation programs between the City and Ann Arbor Public Schools. This agreement addresses AAPS’ use of City facilities for the AAPS Community Education and Recreation (Rec & Ed) program.

 

The prior agreement was approved in 2010 and has operated on a renewal basis since then. City staff and Ann Arbor Public School staff worked cooperatively to make amendments and improvements, which include the following:

 

                     An updated list of park and school fields available for use, including updated park names as well as removing spaces no longer used.

                     Clarified responsibilities regarding cancellations related to weather or conflicting programming.

                     Clarified responsibilities and timing for additional activities beyond AAPS Rec & Ed program.

                     Clarified mowing responsibilities as related to general park spaces for Rec & Ed games based on previously agreed upon practices.

                     New fees approved by City Council in May 2025 for third party rentals booked by AAPS.

                     Allowance for future adjustment to fees by City Council.

                     Automatic 1-year renewals following the initial 2-year term unless terminated by either party.

 

The Park Advisory Commission unanimously recommended approval of this agreement at their December 16, 2025 meeting.

Whereas, The City and the Ann Arbor Public Schools have conducted joint recreation programs for over 100 years;

 

Whereas, The City and AAPS wish to update the agreement governing the joint recreation programs;

 

Whereas, The term of the proposed agreement shall be for two years and will automatically renew for a 1-year term each year beginning on January 1 unless terminated by either party;

 

Whereas, The proposed agreement retains the overall structure of the original agreement while incorporating amendments and improvements; and

 

Whereas, The Park Advisory Commission unanimously recommended approval of this agreement at their December 16, 2025 meeting;

 

RESOLVED, That City Council approves the agreement between the City and Ann Arbor Public Schools for Joint Recreation Programs;

 

RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the agreement after approval by the City Administrator and City Attorney; and

 

RESOLVED, That the City Administrator is authorized to take all appropriate actions to implement this resolution and the agreement, including execution of subagreements, change orders, or related documents, and to make all determinations and exercise all authority delegated to the City under the agreement.
