Memorandum
This memorandum and resolution request approval of the professional services agreement with Stantec Consulting Michigan Inc. to provide professional engineering services for the study phase of the West High Service Pump Upgrade and Barton Pump Station Electrical Improvements Project.  This project is included as an urgent project for 2010 and 2011 in the City's approved Capital Improvements Plan.
 
This project includes two components.  The first component is the upgrade of the West High Service Pumps at the Water Treatment Plant.  These pumps provide water to the west side of Ann Arbor as well as Scio Township.  In the City's water services agreement with Scio Township these pumps were scheduled to be upgraded once Scio Township reached a daily demand of 2.5 million gallons per day.  This target was reached several years ago.  Since that time the City has been working with Scio Township to firm up the financing and schedule for this work.  Since this work is driven by Scio Township's water demand they will fund the majority of this work.
 
The second component of this project is to replace some aging electrical switchgear at Barton Pump Station that dates back to 1949.  This switchgear is not compliant with current National Electrical Code and creates a safety hazard for Public Services Staff.  In addition, spare parts are not readily available, and in the event of a failure would be difficult to repair.  Failure of this equipment would jeopardize the Water Treatment Plant's ability to provide a sufficient quantity of water to City customers.
 
Because similar equipment will likely be included in both of these projects, the coordinated timing of these projects, and the economy of scale generated by combining them, it was decided to issue a single Request for Proposal.  The Water Treatment Plant issued Request for Proposal (RFP) No. 729 in September 2009 and received five proposals.  Based on the criteria identified in the RFP, the selection committee selected Stantec Consulting Michigan Inc. as the most qualified firm to provide the services requested.
 
It is therefore recommended that the proposal from Stantec Consulting Michigan Inc. be accepted, and that the Professional Services Agreement with Stantec Consulting Michigan Inc. in the amount of $128,650.00 be approved to provide professional engineering services for the study phase of the West High Service Pump Upgrade and Barton Pump Station Electrical Improvements Project.  Your approval is also requested for a contingency of $15,000.00 for change orders to the contract with Stantec Consulting Michigan Inc. to be approved by the City Administrator.
 
Stantec Consulting Michigan Inc. received Human Rights approval on February 17, 2010, and complies with the living wage ordinance.
 
Upon completion of the study phase of this project, the City staff will prepare a resolution requesting Council approval for the design and construction services portions of this project.
Scio Township shall fund $73,270.00 for their portion of the work.  The balance in the amount of $55,380.00 for the study phase of the project will be funded from the FY10 and FY 11 Capital Projects Budget that includes this project and are to be advanced from the Water Supply System Operating Fund Balance to be repaid pending the sale of water revenue bonds via the Drinking Water Revolving Loan Fund (DWRF).

Whereas, It is necessary to complete West High Service Pump Upgrade Project to provide additional pumping capacity to meet Scio Township's current and projected water demands;
 
Whereas, It is necessary to complete Barton Pump Station Electrical Improvements Project to replace switchgear that has exceeded it expected life and is not compliance with current National Electrical Code;
 
Whereas, This project is included as part of the Drinking Water Revolving Loan Fund application made by the City for a select number of water system projects and was accepted for funding through this program;
 
Whereas, The West High Service Pump Upgrade Project and Barton Pump Station Electrical Improvements Project were identified as urgent in the approved CIP;
 
Whereas, Council approved this project and associated funding during the FY10 and FY11 Capital Budget process;
 
Whereas, A portion of the funding for this project will be provided by Scio Township in the amount of $73,270.00 for the study phase;
 
Whereas, Of the five firms that submitted proposals, Stantec Consulting Michigan Inc. was selected as the most qualified firm to provide services for this project;
 
Whereas, The cost of the study phase of this project is $128,650.00; and
 
Whereas, Stantec Consulting Michigan Inc. has received Human Rights approval on February 17, 2010, and complies with the living wage ordinance.
 
RESOLVED, That Council accept the proposal and approve the professional services agreement with Stantec Consulting Michigan Inc. in the amount of $128,650.00 to provide professional engineering services for the study phase of the West High Service Pump Upgrade Project and Barton Pump Station Electrical Improvements Project;
 
RESOLVED, That Council approve a contingency to the professional services agreement with Stantec Consulting Michigan Inc. in the amount of $15,000 to finance change orders to be approved by the City Administrator;
 
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the professional services agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney;
 
RESOLVED, That the City makes the following declaration for the purpose of complying with the reimbursement rules of Treas. Reg. 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds;
 
RESOLVED, That funding in the amount of $55,380.00 for the study phase of this project was approved in the FY10 and FY11 Capital Projects Budgets and are to be advanced from the Water Supply System Operating Fund Balance to be repaid pending the sale of water revenue bonds via the Drinking Water Revolving Loan Fund (DWRF); and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
