Resolution to Accept an Amended Sidewalk Easement at 2111 Packard Street from Packard ROW Owner, LLC (8 Votes Required)

Memorandum

This easement is given pursuant to the Site Plan approved by City Council on February 1, 2021, in R-21-043. City Council previously accepted a sidewalk easement on September 16, 2024, R-24-380, which was recorded at the Washtenaw County Register of Deeds on September 18, 2024, in Liber 5565, page 539. Said easement is being amended to accommodate the installation of a wing wall within a portion of the sidewalk easement. The amended easement is intended to supersede and replace the easement recorded in Liber 5565, page 539.

Whereas, Packard ROW Owner, LLC , a Michigan limited liability company, is the owner of property commonly known as 2111 Packard Street, Ann Arbor MI 48104; and

 

Whereas, Packard ROW Owner, LLC, has signed a grant of amended easement for public sidewalk described below and shown on the attached map:

 

Beginning at the Northwest corner of Lot 5, Eastover Hills, a subdivision of part of the Northeast ¼ of Section 4, T3S, R6E, City of Ann Arbor, Washtenaw County, Michigan, as recorded in Liber 3 of Plats, Page 5, Washtenaw County Records; thence N89º58’53” E 247.51 feet along the Northerly lines of said Lot 5 and Lot 24 of said Eastover Hills and the Southerly right-of-way line of Anderson Avenue; thence S00º01’07”E 5.50 feet; thence S89º58’53”W 215.38 feet; thence N86º36’49”W 19.01 feet; thence S89º58’49”W 10.79 feet; thence N25º16’00”W 4.83 feet along the Southwesterly line of said Lot 5 and the Northeasterly right-of-way line of Packard Street to the Point of Beginning.  Being a part of Lots 5 and 24, Eastover Hills, a subdivision of part of the Northeast ¼ of Section 4, T3S, R6E, City of Ann Arbor, Washtenaw County, Michigan, as recorded in Liber 3 of Plats, Page 5, Washtenaw County Records and containing 1332 square feet of land, more or less.

 

RESOLVED, That the City of Ann Arbor hereby accepts this grant of easement.
