Resolution to Approve a Contract with Fiber Optic Management, LLC d/b/a Turnkey Network Solutions for On-Demand Fiber Optic Architecture, Engineering, Design, and Construction RFP #23-31 (Not to Exceed $200,000.00 annually)
Memorandum
We recommend your approval of the attached resolution authorizing a contract for FY24 - FY26 in an amount not to exceed $200,000.00 annually with Fiber Optic Management, LLC d/b/a Turnkey Network Solutions to provide On-Demand Fiber Optic Architecture, Engineering, Design, and Construction services. These services will provide fiber optic network expansion to the City of Ann Arbor, community, and commercial organizations.
Proposals were solicited for On-Demand Fiber Optic Architecture, Engineering, Design, and Construction through RFP #23-31 issued by the City. Bids were scored on a best value basis since this contract also includes construction of a public improvement as defined under the best value ordinance. Of the two responses received, the proposal from Fiber Optic Management, LLC d/b/a Turnkey Network Solutions was selected as the most responsive proposal to the RFP.
The term for the contract will be for 3 years from the effective date of the agreement with the option to extend for three additional 2-year periods upon approval of the City Administrator. A purchase order in an amount not to exceed $200,000.00 annually would be issued and subject to funding availability.
Budget/Fiscal Impact: Funding for these services is subject to available City of Ann Arbor department level funding or funds provided by community or commercial organizations. The services rendered under this contract shall not be paid for from the Information Technology Fund or the Technology Fiber Fund unless the services rendered are being reimbursed to either of these funds.
Fiber Optic Management, LLC d/b/a Turnkey Network Solutions complies with the City’s Living Wage and Non-Discrimination ordinances.

Whereas, There is a need to provide expansion to the City of Ann Arbor fiber optics networks;
Whereas, Fiber Optic Management, LLC d/b/a Turnkey Network Solutions provided the most responsive proposal for On-Demand Fiber Optic Architecture, Engineering, Design, and Construction services solicited through RFP #23-31;
Whereas, The IT Department recommends approval of a three-year On-Demand Fiber Optic Architecture, Engineering, Design, and Construction agreement with Fiber Optic Management, LLC d/b/a Turnkey Network Solutions, with the option to extend the agreement for three additional 2-year terms under the same terms and conditions, with the pricing adjusted as provided in RFP #23-31;
Whereas, Funding for these services is available from City of Ann Arbor department budgets, community, or commercial organization funding; and
Whereas, Fiber Optic Management, LLC d/b/a Turnkey Network Solutions complies with the City of Ann Arbor Non-Discrimination and Living Wage Ordinances;
RESOLVED, That City Council approves a three-year agreement with Fiber Optic Management d/b/a Turnkey Network Solutions, in the amount of not to exceed $200,000.00 annually for On-Demand Fiber Optic Architecture, Engineering, Design, and Construction services (RFP #23-31);
RESOLVED, That the City Administrator be authorized to extend the agreement for up to three additional 2-year periods on the same terms and conditions and subject to price and rate adjustments set forth in the agreement which are subject to the availability of funding;
RESOLVED, That these services, during the life of the agreement, shall be funded from the City of Ann Arbor department level budgets, community or commercial organization funding and shall not be paid for from the Information Technology Fund or the Technology Fiber Fund unless the services rendered are being reimbursed to either of these funds from other City funds or outside entities;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution.
