An Ordinance to Amend Chapter 55 (Zoning), Rezoning of 0.17 Acres from R4C (Multiple-Family Dwelling) to D1 (Downtown Core), Midtown Character, and Secondary Street, The Dean II Rezoning, 548 S Fifth Ave (CPC Recommendation: Approval - 7 Yeas and 0 Nays)

Memorandum

Approval of this ordinance will rezone a 7,600-square foot lot from R4C (Multiple-Family Dwelling) to D1 (Downtown Core base), Midtown Character overlay, and Secondary Street frontage designation to allow the site to be included in the development of a high-rise apartment building. An area plan, for separate approval by resolution, has been submitted as required to illustrate how the subject site will be incorporated and demonstrating compliance with the proposed zoning designations.

 

The site is adjacent to and will be included with the 41,461-square foot site of The Dean, a proposed site plan under separate review, to allow the Dean site to be increased to 49,060 square feet and develop with a 15-story residential building with approximately 240 apartments. The original Dean site was rezoned from R4C and M1 (Limited Industrial) to D1, Midtown, and Secondary Street with Conditions by approval of Ordinance 26-06 on March 2, 2026 and incorporating the Dean Conditional Zoning Statement of Conditions to require a minimum 10-foot side and rear setback where adjacent to residential zoning. The Dean II rezoning will extend the boundaries of the zoning district, including the same conditions.

 

The City Planning Commission determined that the proposed rezoning is consistent with the adjacent zoning, the surrounding land uses, and the City's Comprehensive Plan and recommended approval of the request at its meeting of August 18, 2026.
