Resolution to Extend the Contract with P.K. Contracting, Inc. for Pavement Marking Maintenance - FY2022 ($445,000.00)

Memorandum

Attached for approval is a resolution to authorize extension of a unit price contract (ITB No. 4631) with P.K. Contracting, Inc., in the amount of up to $445,000.00 for the citywide maintenance of pavement markings.

 

This project involves replacing pavement markings on streets throughout the City, including markings to delineate traffic and bike lanes, markings at intersections, markings at school and mid-block crossings, those required for traffic calming features, and miscellaneous others.

 

The City awarded P.K. Contracting, Inc. a contract for pavement marking maintenance in FY2021. This contract provides for a one-year extension for FY2022 by mutual agreement. The City has repeatedly awarded a similar contract to P.K. Contracting, Inc. in numerous prior years. Most often, this contractor is the lone responder to bid solicitations for this type of work. City staff recommends extending this contract for one year.

 

This contract is a unit price contract, created with the understanding that the actual quantities used in construction will vary. Staff expects work under this contract to begin on or after July 1, 2021, and to be complete by June 30, 2022.

 

P.K. Contracting, Inc. complies with the City of Ann Arbor Non-Discrimination and Living Wage Ordinances.

 

Budget/Fiscal Impact:  Funding for this work is available in the adopted FY2022 Public Services Area appropriate Operation and Maintenance Budgets. Operationally, these improvements will benefit the safety of patrons using the City’s motorized and non-motorized transportation systems. The availability of funds, and needed pavement marking maintenance and replacement is the basis of the contract amount.

Whereas, It is appropriate to replace pavement markings throughout the City to help maintain a safe environment on the City’s roadways;

 

Whereas, The Pavement Marking Maintenance - FY2022 Contract involves replacing pavement markings on City streets;

 

Whereas, These pavement marking improvements will benefit residents and visitors who use the City’s motorized and non-motorized transportation systems;

 

Whereas, The City received bids on May 27, 2020, and P.K. Contracting, Inc. was the lone responsible bidder;

 

Whereas, P.K. Contracting, Inc. has performed pavement marking maintenance repeatedly in prior years to the satisfaction of the City;

 

Whereas, The current contract sets forth the services to be performed by said P.K. Contracting, Inc., and the payments to be made by the City there for, all of which are agreeable to the City;

 

Whereas, The City’s current contract with P.K. Contracting, Inc. allows its extension for one (1) one-year term, subject to the terms and conditions in the original contract;

 

Whereas, Funding for an extension is available in the adopted FY2022 Public Services Area appropriate Fund Operation and Maintenance Budgets; and

 

Whereas, P.K. Contracting, Inc. complies with the City of Ann Arbor Non-Discrimination and Living Wage Ordinances;

 

RESOLVED, That City Council approve a contract extension in the amount of up to $445,000.00 with P.K. Contracting, Inc. for Pavement Marking Maintenance - FY2022;

 

RESOLVED, That a contingency amount of $5,000.00 be established, and that the City Administrator be authorized to approve additional change orders/contract modifications to the pavement marking contract with P.K. Contracting, Inc., not to exceed $5,000.00 in order to satisfactorily complete the project; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution including approval of needed Traffic Control Orders, night work authorizations, and other similar administrative approvals to allow the work of the project to proceed without delay.
