Resolution to Grant an Easement through Mary Beth Doyle Park to DTE Electrical Company for New and Existing Electrical Utility Service (8 Votes Required)

Memorandum

DTE and MDOT have requested an easement to install a new electrical line across the City-owned portion of Mary Beth Doyle Park, previously known as Brown Park, to provide power to an MDOT facility in the I-94 right-of-way.

 

Near the location of the proposed new electrical service are existing utility poles and overhead lines for which DTE does not have an easement. This resolution authorizes granting of an easement for the existing and proposed lines.

 

The proposed easements have been reviewed and approved by all required City service areas. The Park Advisory Commission recommended approval of the easements at its May 21, 2024 meeting.

RESOLVED, That the City of Ann Arbor hereby approves a grant of easement for the construction and maintenance of electrical utility service located in Mary Beth Doyle Park, described as follows:

 

EASEMENT AREA 1

A 15 feet wide Overhead Electric Easement in part of the Southeast ¼ of Section 10, Town 3 South, Range 6 East, City of Ann Arbor, Washtenaw County, Michigan, being more particularly described by its centerline as:  Commencing at the Center of Section 10, then North 87 degrees 47 minutes 20 seconds East, 456.26 feet along the East and West ¼ line of said Section 10 to the Point of Beginning; thence South 00 degrees 10 minutes 08 seconds East, 238.84 feet to a point hereafter known as Point “A”; thence North 83 degrees 16 minutes 17 seconds West,168.36 feet to a point hereafter known as Point “B” and the Point of Ending. The sidelines of said easement are lengthened or shortened at the East and West ¼ line of said Section 10.  Together with two (2) 6 feet wide Anchor Slot Easements described by their centerlines as:  (1) Beginning at said Point “A”; thence South 82 degrees 33 minutes 19 seconds East, 21.00 feet to the Point of Ending. (2) Beginning at said Point “B”; thence North 85 degrees 57 minutes 41 seconds West, 31.00 feet to the Point of Ending.

 

EASEMENT AREA 2

A 15 feet wide Overhead and Underground Electric Easement in part of the Southeast ¼ of Section 10, Town 3 South, Range 6 East, City of Ann Arbor, Washtenaw County, Michigan, being more particularly described by its centerline as:  Commencing at the Center of Section 10, thence North 87 degrees 47 minutes 20 seconds East, 456.26 feet along the East and West ¼ line of said Section 10; thence South 00 degrees 10 minutes 08 seconds East, 238.84 feet; thence North 83 degrees 16 minutes 17 seconds West, 168.36 feet to the Point of Beginning; thence South 26 degrees 05 minutes 27 seconds West, 44.64 feet to the Point of Ending on the Northerly Right of Way line of Interstate 94 Expressway, 200 feet wide. The sidelines of said easement are lengthened or shortened at the Northerly Right of Way line of Interstate 94 Expressway; and

 

RESOLVED, That the Mayor and City Clerk are authorized to execute the grant of easement after approval as to form and content by the City Attorney.
