Attached for your review and approval is a resolution to approve Amendment Number 1 to the Professional Services Agreement for project management and construction engineering Services with Fishbeck for the EMCD Bridge Project (RFP 22-77) in the amount of $368,193.77, bringing the total of the contract to $1,293,560.77.
On January 23, 2023, City Council passed R-23-018, approving the professional services agreement with Fishbeck in the amount of $925,367.00 to perform the project management and construction engineering services for the E. Medical Center Drive Rehabilitation and Widening Project.
Additional project management and construction engineering services are required to support the ongoing construction of the E. Medical Center Drive Rehabilitation and Widening Project for an anticipated additional 121 days of inspection services due to a longer project timeframe. The requested amount was determined from previous fees for daily inspection services and associated administration.
Due to the complexity of the work, City Staff is recommending re-establishing the same previously approved contingency of $100,000.00 for potential future change orders.
Fishbeck complies with the requirements of the City’s Conflict of Interest, Non-Discrimination and Living Wage ordinance.
Budget/Fiscal Impact: The services provided through this agreement will be paid for from the project budget, which is funded by the Street, Bridge, and Sidewalk Millage and contributions from the University of Michigan.

Whereas, The E. Medical Center Drive Rehabilitation and Widening Project timeline has been extended, requiring an additional 121 days of construction inspection and other related services;
Whereas, The City seeks to amend the Professional Services Agreement with Fishbeck for continued project management and construction engineering services for the project;
Whereas, The City will invoice the University of Michigan for their share of the project costs in accordance with Cost Sharing Agreement for the project (R-24-052); and
Whereas, Fishbeck is in compliance with the requirements of the City’s Non-Discrimination and Living Wage ordinances;
RESOLVED, That City Council approve Amendment No. 1 to the Professional Services Agreement with Fishbeck for the East Medical Center Drive Bridge Rehabilitation and Widening Project in the amount of $368,193.77, for a total contract amount of $1,293,560.77;
RESOLVED, The previously approved contingency amount of $100,000.00 remain within the Project budget, and that the City Administrator be authorized to approve additional amendments not to exceed that amount in order to satisfactorily complete the project;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said amendment after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
