Emergency Change Order with Goddard Coatings for Repair of the Tennis and Pickleball Courts at Burns Park ($8,440.00)

Memorandum

This communication notifies City Council of an emergency purchase per City Code 1:317. In fall 2021, the tennis courts at Burns Park underwent improvements, including crack repair, resurfacing, and the conversion of one tennis court into two pickleball courts. By spring 2022, the resurfacing began to fail and required repair. The original contractor, Laser Striping, refused to honor the one-year warranty under the contract, leading to ongoing litigation. Laser Striping was also under contract to repair and resurface the Baxter Park basketball court, which was initially scheduled for FY22. Due to issues with Burns Park, the decision was made to not move forward with Laser Striping performing the work at Baxter Park.

 

At that time, there were only three known court surfacing contractors in Michigan: Goddard Coatings, Courts Unlimited, and Laser Striping. Parks & Recreation has previously engaged both Goddard Coatings and Courts Unlimited with good results. For the necessary repairs at Burns Park and the Baxter Park project, quotes were requested from both contractors. Goddard Coatings provided quotes, while Courts Unlimited was unable to accommodate the work. A purchase order (PO) 2023- 00000860 was issued to Goddard Coatings for $71,000.00 to resurface the courts at both Burns and Baxter Parks in FY24.

 

Goddard Coatings commenced work in May 2024, which included power-washing and cleaning the courts in preparation for crack repair and new acrylic sports surfacing. During preparation, additional defects from the previous failed resurfacing project were revealed. The Rite-Way Crack Repair System, initially believed to be correctly installed, had also failed. Goddard Coatings identified 422 linear feet of failing Rite-Way Crack Repair fabric that needed replacement to ensure successful resurfacing.

 

The cost for this additional work was $8,440.00, increasing the project total to $79,440.00, which typically would require City Council approval. With construction already in progress, the courts were unplayable. An emergency purchase order increase was requested to allow Goddard Coatings to proceed with the necessary repairs, enabling the restoration of the popular tennis and pickleball courts to be completed promptly.

 

Section 1:317 of City Code allows the City Administrator to authorize emergency purchase orders. The City Administrator approved the emergency change order on May 22, 2024, allowing the contractor to complete the project.
